HomeMy WebLinkAboutOrdinance - 2002-O0009 - Amending Chapt. 9 Changes In Voting Precincts By Order Of U.S. District Court - 01/10/2002First Reading January 10, 2002 Item No. 41 Second Reading January 23, 2002 Item No. 23 ORDINANCE NO. 2002-o0009 AN ORDINANCE AMENDING CHAPTER 8 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, BY AMENDING THE LANGUAGE OF SECTION 8-4 WITH REGARD TO VOTING PRECINCTS AND VOTING PLACES AS REQUIRED BY STATE LAW DUE TO CHANGES IN VOTING PRECINCTS MADE BY LUBBOCK COUNTY PURSUANT TO THE ORDER OF THE U.S. DISTRICT COURT IN THE STATE REDISTRICTING CASE OF BALDERAS V: STATE OF TEXAS (ED TEX. NO 6:01CV158); PROVIDING A MAP OF THE VOTING PRECINCTS AND DISTRICTS OF THE CITY OF LUBBOCK; PROVIDING A SAVINGS CLAUSE; PROVIDING THAT ALL PORTIONS OF CHAPTER 8 NOT AMENDED SHALL REMAIN THE SAME; PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the U.S. District Court on November 28,2001, entered an order approving the realignment of certain voting precinct boundaries in Lubbock County in connection with Balderas v. State ofTexas, No. 6:01CV158 (E.D. Tex.) (State legislative redistricting); and WHEREAS, Lubbock County on December 10, 2001, established two new county voting precincts within the City of Lubbock and realigned two other precinct boundaries to comply with said Court order; and WHEREAS, Section 42.061 (?fthe Texas Election Code requires the City of Lubbock align its voting precincts With those of Lubbock County except where the city limits line intervenes; and WHEREAS, such changes to voting precinct boundaries will not affect the City of Lubbock's voting districts; and WHEREAS, certain other changes need to be made with regard to City of Lubbock voting locations in various city voting precincts due to unavailability of past voting locations, redistricting and other causes; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT subsection 8-4(a) ofthe Code of Ordinances of the City of Lubbock, Texas, is hereby amended to read as follows with regard to Voting Precinct Nos. 57 and 112 and adding new Voting Precinct Nos. 115 and 116: Voting Precinct No. 57. Beginning at the intersection of Alcove Avenue and 19th Street; thence east along 19111 Street to its intersection with Milwaukee Avenue; thence south along Milwaukee Avenue to its intersection with the Lehman Branch of the West Texas and Lubbock Railroad; thence northwest along the Lehman Branch of the West Texas and Lubbock Railroad to a point 660 feet west of the centerline of Milwaukee A venue, thence north along a line parallel to and 660 feet west of the centerline of Milwaukee A venue to a point 660 feet south and 660 feet west of the intersection of Milwaukee A venue and 34th Street, thence west along a line parallel to and 660 feet south of the centerline of 34th Street to its intersection with Alcove A venue, thence north along Alcove Avenue to the point ofbeginning. The voting place shall be St. Theresa Catholic Church. Voting Precinct No. 112. Beginning at a point in the north right-of-way line ofU. S. Highway 62 that is 660 feet west ofthe centerline ofUpland Avenue; thence north along a line (the city limits) parallel to and 660 feet west of the centerline of Upland Avenue to its intersection with the Lehman Branch of the West Texas and Lubbock Railroad, thence southeasterly along the Lehman Branch of the West Texas and Lubbock Railroad to a point 660 feet west of the extension of the centerline of Milwaukee Avenue, thence south a long a line parallel to and 660 feet west of the extension of the centerline of Milwaukee Avenue to its intersection with the north right-of-way line ofU. S. Highway 62, thence southwesterly along the north right-of-way line ofU. S. Highway 62 to the point ofbeginning. The voting place shall be consolidated with the nearest permanent voting location in the same district until such time as a suitable public building and population increase require the establishment of a permanent voting location. Voting Precinct No. 115. Beginning at a point 660 feet south and 660 feet west of the intersection of 34tn Street and Upland A venue; thence east along a line 660feet south of and parallel to the centerline of 34th Street to a point 660 feet south and 660 feet west ofthe intersection of341h Street and Milwaukee Avenue, thence south along a line 660 feet west and parallel to Milwaukee A venue to the intersection with the Lehman Branch of the West Texas and Lubbock Railroad; thence northwesterly along the West Texas and Lubbock Railroad to a point 600 feet west of Upland Avenue, thence north along a line (the city limits) 660 feet west of and parallel to Upland Avenue to the point of beginning. The voting place shall be consolidated with the nearest permanent voting location in the same district until such time as a suitable public building and population increase require the establishment of a permanent voting location. Voting Precinct No. 116. Beginning at the point of intersection of the Lehman Branch of the West Texas and Lubbock Railroad and a point 150 feet west of the west section line of Section 3 7, Block AK, thence south along a line 150 feet west of and parallel to the west section line of Section 37, Block AK and Section 36, Block AK to its intersection with the Seagraves Branch of the West Texas and Lubbock Railroad, thence southwesterly along the Seagraves Branch of the West Texas and Lubbock Railroad to a point 660 feet west of the west section line of Section 36, Block AK, thence north along a line 660 west of and parallel to the west section line of Section 36, Block AK and Section 37, Block AK to its intersection with the Lehman Branch of the West Texas and Lubbock Railroad, thence southeasterly along the Lehman Branch of the West Texas and Lubbock Railroad to the point of beginning. The voting place shall be consolidated with the nearest 2 permanent voting location in the same district until such time as a suitable public building and population increase require the establishment of a permanent voting location. SECTION 2. THAT the voting locations for the following named precincts shall be amended to read as follows: Voting Precinct No. 58. The voting place shall be consolidated with the nearest permanent voting location in the same district until such time as a suitable public building and population increase require the establishment of a permanent voting location. Voting Precinct No. 63. The voting place shall be consolidated with the nearest permanent voting location in the same district until such time as a suitable public building and population increase require the establishment of a permanent voting location. Voting Precinct No. 93. The voting place shall be consolidated with the nearest permanent voting location in the same district until such time as a suitable public building and population increase require the establishment of a permanent voting location. Voting Precinct No. 96. The voting place shall be consolidated with the nearest permanent voting location in the same district until such time as a suitable public building and population increase require the establishment of a permanent voting location. Voting Precinct No. 111. The voting place shall be the Disabled American Veterans-Chapter 44 building, 7444 83rd Street. SECTION 3. THAT subsection 8-4( c) of the Code of ordinances of the City of Lubbock, Texas, is hereby amended to read as follows: (c) The voting districts, voting precincts and voting places set out in this section are hereby delineated on the map denominated "City of Lubbock Voting Precincts/Districts, effective January 31, 2002/0fficial Map." A copy of said map is attached and made a part of this section as if fully copied herein in detail. A copy of the original of such map shall be kept in the office of the City Secretary and shall be available for public inspection, and at each special and general city election, a true copy of said map shall be furnished by the City Secretary to each ofthe presiding judges of the voting precincts for such special or general city election. SECTION 4. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 5. THAT all portions of Chapter 8 not expressly amended by this Ordinance shall remain as they are. 3 SECTION 6. THAT the City Secretary is hereby authorized and directed to cause publication of this Ordinance in its entirety following final passage by the City Council. SECTION 7. THAT this Ordinance shall be effective on and after January 31, 2002. AND IT IS SO ORDERED. Passed by the City Council on first reading this lOth day of January , 2002.
