AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 M~D THE OFFICIAL ~~ OF THE
· CITY OF LUBBOCK SO AS TO HAKE THE FOLLmVING CHANGES: ZONE CASE HO. 2162; CHANGE
TRACTS "A" THROUGH 11M", TRACTS "P", 11Q", "R" AND THE SOUTH 200 FEET OF LOTS 1-A, 2-A
AND 3-A, FIESTA AUTOLAND CENTER, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM C-4 TO
C-4 ZONING DISTRICT; SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS
CLAUSE AND PROVIDING FOR PUBLICATION.

WHEREAS, the proposed changes in zoning districts as hereinafter made have been
duly presented to the Planning and Zoning Commission for its recommendation which
was received by the City Council and, after due consideration, the City Council finds
that making the proposed changes as hereinafter set out will be in the public interest
and,
HHEREAS, all conditions precedent required by law for a valid amendment to the
Zoning Ordinance and Map have been fully complied with, as well as giving notices
in compliance with Section 26 of Ordinance No. 7084, as well as notices provided by
Article 1011£, Vernon's Annotated Civil Statutes, amended in 1961, and notice was
duly published in the Lubbock Horning Avalanche-Journal more than fifteen (15) days
prior to t he date of the public hearing before the City Council on such proposed
amendment, and the public hearing according to said notice was duly held in the City
Council Room on the second floor of the City Hall, Lubbock, Texas, at which time
persons appeared in support of the proposal; and, after said hearing, it was by the
City Council determined that it would be in the public interest, due to changed
conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner
hereinafter set forth in the body of this Ordinance and this Ordinance having been
introduced prior to first reading hereof; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Hap BE and the same
are hereby amended as follmvs, to-wit:
ZONE CASE NO. 2162
1. Change the North 295 feet of Tract 11M"; Tracts "P" and "Q" and '1R11
and Lots 1-A, 2-A and 3-A, Fiesta Autoland Center, City of Lubbock,
Lubbock County, Texas, from C ... 4 to C-4 Zoning Dictrict,
SUBJECT TO THE FOLLOWING CONDITIONS:
1. That the property uses be limited to the following:
(a) Any use conditionally or unconditionally permitted in the 11C-2A", "C-2"
or "C-3" districts.
(b) Agricultural implement and tractor sales and service (totally within
a building).
(c) Automobile body shops, outside storage limited to customer vehicles only.
(d) Automobile brake shop.
(e) Automobile glass shop.
(£) Automobile seat cover and upholstery shop.
(g) Automobile transmission shop.
{h) Automobile and recreational vehicles sales and service (may include body
and paint shop, as accessory use).
(i) Barber and beauty shop supply dealer.
(j) Boat and boat trailer sales and service.
(k) Builders supply (all materials must be in a building).
(1) Cafe supply dealer, fixtures.
(m) Candy plant.
(n) Canvas goods shop, te.nts and awnings (no manufacturing).
(o) Dairy supply dealer.
(p) Electrical equipment repairs.
(q) Frozen food lockers.
(r) Furniture store, used (all merchandise must be in a building).
(s) Garage, public, repair (outside storage of customer automobiles
authorized; all work and separate parts shall be inside a building).
(t) Gasoline service station (business permitted outside of building and
outside displays of products permitted within three (3) feet of building).
(u) Golf driving range (business permitted outside of building).
(v) Greenhouse and plant nursery.
(w) Hotel or Motel.
(x) Hot tamale plant.
(y) Janitorial or cleaning service.
(z) Job printing and lithographing.
(aa) Laboratory, chemical, general analysis.
(bb) Linen and towel supply service.
(cc) Lumber yard, with no mill (all materials must be in a building).
(dd) Magazine agency.
(ee) Mobile home sales.
(ff) Honument sales (outside display permitted).
(gg) Muffler shop.
(hh) Non-profit training centers with retail sales.
(ii) Pest control service.
(jj) Print shop.
(kk) Rental store.
(11) Rental store, heavy equipment and trailers only.
(mm) Restaurants, with the sale of alcoholic beverages as an incidental use,
except that no mixed alcoholic beverage sales shall be made or delivered
to occupants in motor vehicles.
(nn) Road machinery sales and service (totally within a building).
(oo) Second hand or used car sales lot, not including wrecking and repairing,
but including minor tuning.
(pp) Sign shops, limited to window lettering, painted wall signs, banners,
and desk signs.
(qq) Store fixtures sales (no manufacturing permitted).
(rr) Swimming pool, commercial or sales (business permitted outside building).
(s s) Trailer and truck sales, rental or service.
(tt) Trailer and truck rental utility.
(uu) Upholstery-shop-furniture.
(vv) Veterinary Hospital (totally l.;rithin a building).
(ww) Wholesale house, sales office and storage -no· cotton storage.
2. That for the North 295 feet of Tract "11'', there be no windows above the
first story which are visible from any rear property line of Tracts "A"
through "X".

2. Change Tracts "A" through "L" and the South 157 feet of Tract 11M'', Fiesta
Autoland Center, City of Lubbock, Lubbock County, Texas, from C-4 to C-4
Zoning District,

1. That the property uses be limited to the following:
(a) Any use conditionally or unconditionally permitted in the "C-2A", "C-2"
or "C-3" districts.

2. That in the event the South 157 feet of Tract "M11 should be used for the site
of an automobile brake shop, automobile and recreational vehicles sales and
service, if including a body and paint shop as an accessory use, or a print
shop, then there shall be erected and permanently maintained o~ the southpro
perty line of Tract "M'', a 7 feet high solid, masonry screEhl fence.
3. That for Tracts "A" through "L" and the South 157 feet of Tract "M", there
be no windows above the first story which are visible from any rear property
line of Tracts "A" through "t-I''.
SECTION 2. THAT from and after passage and effective date of this Ordinance
said lots, tracts and parcels of land described in Section 1 hereof shall be changed
to the zoning district indicated and the Official Nap is amended in accordance herewi
SECTION 3. THAT any person, firm or corporation owning or operating the subject
property failing to comply with the conditions imposed by Section 1 hereof shall be
guilty of a misdemeanor and upon conviction thereof, shall be subject to a fine not
to exceed TWO HUNDRED DOLLARS and each and every day's violation thereof shall con-
stitute a separate and distinct offense.
The failure of any corporation owning or operating the subject property to compl
with any of the conditions imposed by Section 1 hereof shall render the President,
Vice-President, General Manager, Local Manager and Local Agent liable to the penalty
prescribed in this section.

SECTION 4. THAT should any section, paragraph, sentence, clause, phrase or
word of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.
SECTION 5. THAT the City Secretary is hereby authorized to cause publication
of the descriptive caption of this Ordinance as an alternative method provided by
law.
