ORDINANCE NO. 7502
AN ORDlNANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE
OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOW
NG CHANGES: ZONE CASE NO. 2144; CHANGE A TRACT OF LAND OUT
OF SECTlON 28. BLOCK E-2, LUBBOCK COUNTY, TEXAS, FROM R-1 TO
M-1 ZONING DISTRICT; SUBJECT TO QONDITIONS; CHANGE A TRACT OF
LAND OUT OF SECTION 36, BLOCK A-K, LUBBOCK COUNTY, TEX-A.S.
FROM R-1 TO M-1 ZONING DISTRICT: SUBJECT TO QONDITIONS; PRO-
VIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR
PUBLICATION.
WHEREAS, the proposed changes in zonmg d1str1cts as hereinafter made
~ave been duly presented to the Plannmg and Zonmg Commiss1on for its
fl'ecommendation which was received by the City Councu and, after due consider-
fa.tion, the City Council finds that making the proposed changes as heremafter
set out will be m the public interest; and,
WHEREAS, all co:J.d1tlons precedent required by law for a valid amend-
ment to the Zoning Ordinance and Map have been fully complied with, as well
as giving nottces in compliance wtth Section 26 of Ordinance No. 7084, as
well as notices provided by Article lOllf, Vernon's Annotated Civil
Statutes, amended in 1961, and notice was duly published m the Lubbock
Morning Avalanche Journal more than fifteen (15) days prior to the date of the
public hearmg before the City Council on such proposed amendment, and the
publ1c hearing accordmg to said notice was duly held in the City Council Room
pn the second floor of the City Hall, Lubbock, Texas, at which t1me persons
appeared in support of the proposal; and, after said hearing, it was by the
City Council determined that it would be in the public mterest, due ito changed
conditions, that the Zoning Ordinance and the Zoning Map be amended in the
~anner heremafter set forth in the body of this Ordinance a:1d this Ordinance
~aving been introduced prior to first reading hereof; NOW THE.REFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE ClTY OF LUBBOCK: .

and the same are hereby amended as follows, to-w it:
ZONE CASE NO. 2144
A . Change a tract of land out of Section 28, Block E-2. Lubbock
County, Texas from R-1 to M-1 zonmg d istrict. This property is further
described by metes and bounds as follows:
BEGINNING at a point in the West line of said Section 28,
and the North line of Spur 327, which bears N0°00 13011 East
1822. 50 feet from the Southwest corner of Section 28, Block
E-2, Lubbock County, Texas;

1822.50 feet from the Southeast corner of Section 36,
Block A-K, Lubbock County, Texas;
THENCE N89°~8'4.5" West along the North line of
Spur 327, a distance of 1650. 34 feet to a point in the
West line of said Tract 3, Lowery Subdivision;
THENCE North along the West line of Tract 3, Lowery
Subdivision a distance of 1077.40 fe~t;

SUBJECT TO THE FOLLOWING CONDITIONS:
1. That there be a 43 foot building setback on Loop 289 and Spur 327
2. That there be a 25 foot building set back on Frankford and any
interior streets.
3. All~outside storage be screened with a six foot solid screening
fence of masonry or wood and that material not be stacked higher than the
screening fence.
4. That there be 5o/o la•·1dscaping provided on property facing Loop
289 and Spur 327 a..11d 3o/o on all other tracts.
5. That each proposed development be subject to a final site plan
review by the Planning and Zoning Commission prior to a building permit
being issued.
SECTION 2. THAT from a>:1d after passage and effective date of this
Ordinance said lots, tracts and parcels of land described in Section 1 hereof
shall be changed to the zoning district indicated a,"1.d the Official Map is
amended in accordance herewith.
SECTION 3. THAT any person, firm or corporation owning or
operating the subject property failing to comply with the conditions imposed
by Section 1 hereof shall be guiltycof a misdemeanor and upon conviction
thereof, shall be subject to a fine not to exceed TWO HUNDRED DOLLARS
and each and-every day's violation thereof shall constitute a separate and
distinct offense.
'!;he failure of any corporation owning or operating the subject pro-
perty to eomply with any of the conditions imposed by Section 1 hereof

THENCE Northeasterly around a curve to the left, in the

SUBJECT TO THE FOLLOWING CONDITIONS:

SECTION 4. THAT should a.."ly section, paragraph, sentence, clause, phrase
or word of this Ordinance be declared unconstitutional or invalid for any reason,
the remainder of this Ordinance shall not be affected thereby.
SECTION 5. THAT the City Secretary is hereby authorized to cause publi-
cation of the descriptive caption of this Ordinance as an alternative method provide
by law.
