R-2 ZONING DISTRICT; CHANGE A TRACT OF LA'ND OUT OF SECTION 4,
BLOCK E, LUBBOCK COUNTY, TEXAS, FROM R-1 TO A-1 ZONING
DISTRICT: SUBJECT TO CONDITIONS: PROVIDING A PENALTY: PRO-
VIDING A SAVINGS CLAUSE AND PRQVIDING FOR PUBLICATION.
WHEREAS, the proposed changes in zo~ing di stricts as hereinafter mad
have been duly presented to the Planning and Zoning Commission for its
recommendation which was received by the City Council and, after due
consideration, the City Council finds that making the proposed changes as
hereinafter set out will be in the public interest; and,
WHEREAS, all conditions precedent required by law for a valid amend-
ment to the Zoning Ordinance and Map have been fully complied with, as
well as giving notices in compliance with Section 26 of Ordinance No. 7084,
as well as notices provided by Article 1011f, Vernon's Annotated Civil
Statutes, amended in 1961. and notice was duly published in the Lubbock
Morfl!,ng Avalanche Journal more than fifteen (15) days •prior to the date of
the pt.blic hearing before the City Council on such proposed amendment,
and the public hearing according to said notice was duly held in the City
Council Room on the second floor of the City Hall, Lubbock , Texas, at
which time persons appeared in support of the proposal; and, after said
hearing, it was by the City Council determined that it would be in the public
interest, due to changed conditions, that the Zoning Ordinance and the
Zoning Map be amended in the manner hereinafter set forth in the body of
this Ordinance and this Ordinance having been introduced prior to first
reading hereof; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF L1JBBOCK:
SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE
and the same are hereby amended as follows, to-wit: 1
ZONE CASE NO. 2143
A. Change a tract of land o'..lt of Section 4, Block E, Lubbock County,
Texas, from R-1 to C-2 zoning district. This property is further described
by metes a.."ld bounds as follows:
BEGINNING at a 1 I 211 square rod set in the East right-
of-way line of University Avenue as the Northwest Corner

of this tract, from whence a Southwest corner of
Section 4, Block E bears South 1880 feet and West
60 feet;
THENCE East a distance of 782.61 feet to a 112"
square rod set as the Northeast corner of this tract;
THENCE South a dista::1ce of 530 feet to a 1 I 211 square
rod set as the Southeast corner of this tract;
THENCE West, along the North right-of-way line of
78th Street, being 30 feet North of and parallel to the
South line of said North half of the Southwest quarter
of Section 4, a distance of 76 7. 61 feet to a 1 I 2" square
rod set at a point of curvature;
THENCE around a curve to the right, said curve having
a radius of 15 feet, a delta angle of 90°, tangent lengths
of 15 feet and a chord distance of 21.21 feet to a 1/211
sqpare rpd set at a :pgint-of tangency;
THENCE North along the East right-of-way line of
University Avenue, being 60 feet East of and pa.rallel
to the West line of said Section 4, a distance of 515
feet to the PLACE OF BEGINNING and co::1taining
9. 521 acres, more or l ess.
B. Change a tract of land out of Section 4, Blo~k E, Lubbock County,
Texas, from R-1 to R-2 zoning district. This property is further
described by metes and bounds as follows:
BEGINNING at a point which bears North 2640.0 feet

THENCE East a distance of 125. 0 feet;
THENCE South a distance of 578. 0 feet;

OF BEGINNING a.11.d containing 1. 658 acres, more
or less.

C. Change a tract of land out of Section 4, Block E, Lubbock County,
Texas, from R-1 to A-1 zoning district. This property is further described
by metes and bounds as follows:
BEGINNING at a point which bears North 2640. 0 feet and
East 842.61 feet from the Southwest corner of Section 4,
Block E, Lubbock County, Texas;
THENCE East a distance of 6 2 5. 39 feet;
THENCE South a distance of 578. 0 feet;
THENCE West a distance of 625. 39 feet;
THENCE North a distance of 578. 0 feet to the PLACE OF
BEGJN'NING, containing 8. 298 acres, more or less.
SUBJECT TO THE FOLLOWING CONDITION:
1. That it be developed into duplex and quadraplex apartments only.
SECTION 2. THAT from and after passage and effective date of this
Ordinance said lots, tracts and parcels of land described in Section 1 hereof
shall be changed to the zoning district indicated and the Official Map is
amended in accordance herewith.
SECTION 3. THAT any person, firm or corporation owning or pperating
the subject property failing to comply with the condition imposed by Section
1 hereof shall be guilty of a misdemeanor and upon conviction thereof, shall
be subject to a fine not to exceed TWO HUNDRED DOLLARS and each and
every day's violation therof shall constitute a separate and distinct offense.
The failure of any corporationtowning or operating the subject property
to comply with any of the conditions imposed by Section 1 hereof shall render
the President, Vice-President, General Manager, Local Manager and
Local Agent liable to the penalty prescribed in this section.
SECTION 4. THAT should any section, paragraph, S'=ntence, clause,
phrase or word of this Ordinance be declared unconstitutional or invalid for
any reason, the remainder of this Ordinance shall not be affected thereby.
SECTION 5. THAT the City Secretary is hereby authorized to oause pub-
lication of the descriptive caption of this Ordinance as an alternative method
provided by law.
AND IT IS SO ORDERED.
