ORDINANCE NO. 7488
AN ORDINANCE AMENDING SECTIONS 34-10, 34-11 AND 34-12 OF
CHAPTER 34, ARTICLE :r OF THE CODE OF ORDINANCES OF THE CITY
OF LUBBOCK CHANGING THE RATES FOR WATER CONSUMERS, ESTAB-
LISHING MINIMUM RATES AND RATES FOR TEXAS TECH UNNERSITY,
PROVIDING A SAVINGS CLAUSE, AND PROVIDING FOR PUBLICATION OF
THE DESCRIPTIVE CAPTION AS PROVIDED BY LAW.
WHEREAS, on May 21, 1977, the electorate of the City of Lubbock, at
election called for the purpose of determining whether the City of Lubbock
should issue SIXTEEN MILLION SEVEN HUNDRED SEVENTY-FIVE THOU D
AND NO/ 100 DOLLARS ($16, 775, 000. 00) in general obligation bond~ autlio-riz.
the issuance of bonds in such amount for water systems improvement for the
. City of Lubbock; and,
WHEREAS, the City Council is of the opinion and deems it to be in the
public interest that rates be established now to provide for the debt service o
such bonds to be issued hereafter from time to time as the need and occasion
arlises, as it may be determined by the City Council; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Section 34-10, 34-11, and 34-12 of Chapter 34 of
the Code of Ordinances of the City of Lubbock BE amended to read hereafter
as follows:
"Section 34-10. Rates-Amount.
The City, through its Water Department, shall charge
and collect, and every consumer shall pay, for water furnished
by the City to the consumer, the amount calculated by application
of the following rates to meter readings for all billing rendered
from and after October 1, 1977:.

"For townhouse or condominium complex served by a
single connection and meter, the total charges shall be calcu-
lated on the basis of determining the average water usage for
each unit served and applying the minimums and rates herein
provided for single consumers and multiplying such average
per unit cost by the number of units served."
And each year thereafter unless otherwise amended on all
meter readings for all billing from and after the first day of
each October for a period of three years, the rates applicable
and chargeable to each consumer shall be calculated by an
additional amount of ten percent added to each annual rate
schedule as though such schedule was set forth in detail herein.
Provided, however, that the rates presently in effect shall re-
main until the first date heretofore specified to-wit:

Shall remain in effect until September30~ 1977.
"Section 34-11. Minimum Rate.
(a). The minimum rate for water which shall be charged all
consumers exceptas ·oth~,rw1se proy.id.ed, shall be. TWO AND 58/100
DOLLARS ($2. 58).
(b). In calculating the minimum rate to be charged for town-
houses or condominiums. the minimum rate of TWO AND 58/100
DOLLARS ($2. 58) shall be multiplted by the total number of such
building or complex subject to single billing.

Section 34-12. Rate in Application to Texas Tech University.
The rate for water supplied by the City of Lubbock to Texas Tech
University after Septe'mbe.r;; 1~ 1977-shall be FORTY CENTS ($0. 40) per
I_ 000 gallons~ and each year thereafter~ unless otherwise amended.
from and after the first day of each Septembei::fiimaperiod of three years,
the rates applicable and chargeable to Texas Tech University shall be
calculated by an additional amount of ten percent added to each annual
rate schedule as though such schedule was set forth in detail herein,
provided, however,. that the rates presently in effect shall remainuntil
Septe_mbe.r l, 1977. All meters used for measuring water consumed on
the Texas Tech University campus as contemplated by this Section shall
be totaled and the University billed as if water consumed passed through
one meter.
SECTION 2. THAT should any paragraph, sentence. clause, phrase, or
word of this Ordinance be declared unconstitutional or invalid for any reason,
the remainder of this Ordinance shall not be affected thereby.
SECTION 3. THAT the City Secretary is hereby authorized to cause
publication of the descriptive caption of this Ordinance as an alternative
method provided by law.
