FOS:bsb ORDINANCE ·NO. 7489 AN ORDINANCE AMENDING SECTIONS 34-73 OF CHAPTER 34, ARTICLE III OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK CHANGING THE RATES FOR SEWER SERVICE EFFECTIVE OCTOBER 1, 1977 AND OCTOBER 1, 1978, RESPECTIVELY, PROVIDING A SAVINGS CLAUSE, AND PROVIDING FOR PUBLICATION OF THE DESCRIPTIVE CAPTION AS PROVIDED BY LAW. WHEREAS, on May 21, 1977, the Electorate of the City of Lubbock, at an election called for the purpose of determining whether the City of Lubbock should issue TIIREE MILLION THREE HUNDRED AND THREE THOUSAND AND N0/100 DOLLARS ($3,303,000.00) in General Obligation bonds, authorize the issuance of bonds i such amount for expansion of the sanitary sewer system improvements for the City of Lubbock; and WHEREAS, the City Council is of the op1n1on and deems it to be in the public interest that sewer service rates be established now to provide for the debt service on such bonds to be issued hereafter from time to time as the need and occasion arises, as it may be determined by the City Council; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 34-73 of Chapter 34, Article III of the Code of Ordinances of the City of Lubbock BE amended to read hereafter as follows: "Section 34-73 -Rates Charged for Sewer Service. (a) There shall be charged for sewer service to all residences, places of business, private and public buildings, churches, schools and institutions, the following service charge: Single Family Residence - Multi Family Dwelling Units - Rooming Houses - Colleges, Schools, Geriatric Institutions, Orphans Homes, Public or Private Institutions, Except Public Schools - Lubbock Public Schools - Commercial - 5/8" or 3/4" Meter $1.50 per month $1.00 per unit per month $1.00 per month plus 40t per rental room per month 40t per resident, student, patient or inmate; lOt per off-campus resident, student per month lOt per student per month $1.50 per oonth for the first 3,000 gallons; 12t per thousand gallons per month thereafter FOS:bsb 1" Meter - 1 1/2" Meter - 211 Meter - 311 Meter - 4" Meter - 6" Meter - 8" Meter - 10" Meter - Industrial - $2.70 per month for 5,000 gallons minimum; 12i per thousand thereafter $6.00 per month for 12,000 gallons minimum; 12t per thousand thereafter $10.65 per month for 20,000 gallons minimum; 12t per thousand thereafter $24.00 per month for 48,000 gallons minimum; 12¢ per thousand thereafter $42.50 per month for 85,000 gallons minimum; 12t per thousand thereafter $96.00 per month for 190,000 gallons minimum; 12t per thousand thereafter $170.00 per month for 340,000 gallon! minimum; 12t per thousand thereafter $265.00 per month for 535,000 gallon! minimum; 12t per thousand thereafter The charge for industrial users shall be the same as the commercial rate; however,industrial waste that exceed! the allowable strength shall be admit ted to the sewer only by contract with the City and such rate shall be suffi cient to recover the entire cost of transmission treatment, and disposal of the'industrial liquid waste. (b) Effective for all billings scheduled to be rendered on and after October 1, 1977 there shall be charged for sewer service to all residences, places of business, private and public buildings, churches, schools and institutions, the following service charge: Single Family Residence - Multi Family Dwelling Units - Rooming Houses - Universities, Schools, Geriatric Institutions, Orphans Homes, Public or Private Institutions, Except Public Schools - Lubbock Public Schools - Commercial - 5/8" or 3/4" Meter $1. 75 per month $1.15 per unit per month $1.15 per month plus 4St per rental room per month 45t per resident, student, patient or inmate; 12t per off-campus resident, student per month 12t per student per month $1.75 per month for the first 3,000 gallons; 14t per thousand gallons per month thereafter FOS:bsb 1" Meter - 1 1/2" Meter - 2" Meter - 3" Meter - 4" Meter - 6" Heter - 8" Meter - 10" Meter - Industrial - $3.10 per month for 5,000 gallons minimum; 14t per thousand thereafter $7.00 per month for 12,000 gallons minimum; 14t per thousand ·thereafter $12.25 per month for 20,000 gallons minimum; 14t per thousand thereafter $28.00 per month for 48.000 gallons minimum; 14t per thousand thereafter $50.00 per month for 85,000 gallons minimum; 14t per thousand thereafter $110.00 per month for 190,000 gallom minimum; 14t per thousand thereafter $200.00 per month for 340,000 galloru minimum; 14t per thousand thereafter $310.00 per month for 535,000 ga11onl minimum; 14i per thousand thereafter The charge for industrial users shall be the same as the commercial rate; however, industrial waste that exceeds the allowable strength shall be admit ted to the sewer only by contract with the City and such rate shall be suffi· cient to recover the entire cost of transmission treatment, and disposal of the industrial liquid waste. (d) The charge assessed above shall be collected by the City Water Department and included on its regular water statements. In the event the person, firm or institution does not receive water from the City Water Department, a separate monthly statement shall be sent coverin~ such service.11 SECTION 2. THAT should any paragraph, section, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 3. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
