HomeMy WebLinkAboutOrdinance - 7474-1977 - Ordinance Authorizing Issues Of Specific Use Permit; Zone Case No. 2134 - 06/23/1977LGB:bsb ORDINANCE NO. !1474 AN ORDINANCE AUTHORIZING THE ISSUANCE OF A SPECIFIC USE PERMIT, TO-WIT: ZONE CASE NO. 2134; CHANGE LOTS 10, 11 AND 12, BLOCK 5, ELLWOOD PLACE ADDITION, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM A-2 TO C-3 SPECIFIC USE PERl.fiT: PROVIDING FOR CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, after receiving the recommendations of the Planning and Zoning Commission and after due notice and public hearing and all matters having been done and performed as required by Section 22 of Zoning Ordinance No. 7084 of the City of Lubbock (said Ordinance being an Appendix to the Lubbock City Code) relating to Specific Use Permits, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, morals, and general welfare to authorize the granting of the Specific Use Permit as hereinafter set forth; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the Director of Planning of the City of Lubbock is authorized to issue a Specific Use Permit to the Applicant in Zone Case No. 2134 in accordance with the recommendations and condition~ imposed by the Planning and Zoning Commission, on file with the office of the Director of Planning and the City Council which are hereby adopted and incorporated herein by reference for all purposes, provided said Applicant agrees to be bound by the terms of the Specific Use Permit, the granting of v7hich is hereby made subject to compliance to all provisions of Zoning Ordinance No. 7084, an Ordinance of the City of Lubbock, including particularly, but not limited to Section 22 of Zoning Ordinance No. 7084, which provides that a Specific Use Permit and a Building Permit shall be applied for and secured ~rlthin thirty- six (36) months of the effective date of the zone change or all undeveloped property shall automatically revert back to the previous zoning classification and the Director of Planning in such event is directed to remove from the Zoning }~p the legend indicating such limited use. The specific use authorize< by this Ordinance is permitted under provision of Section 22.3-23 of the Zoninl Ordinance on the property respectively described below. ZONE CASE NO. 2134 Change Lots 10, 11 and 12, Block 5, Ellwood Place Addition, City of Lubbock, Lubbock County, Texas, from A-2 to C-3 Specific Use Permit. SUBJECT TO THE FOLLOWING CONDITIONS: 1. That all C-3 development standards shall apply. 2. That the building exterior shall be of materials compatible with and creative of an architectural style similar to that of the attached, existing building. 3. Driveways shall conform to Chapter 28 of the Code of Ordinances of the City of Lubbock. LGB:bsb SECTION 2. THAT any person, firm or corporation owning or operating the subject property failing to comply with the conditions imposed by Section 1 hereof shall be guilty of a misdemeanor and upon conviction thereof shall be subject to a fine not to exceed TWO Hill~DRED DOLLARS and each and every day's violation thereof shall constitute a separate and distinct offense. The failure of any corporation owning or operating the subject property to comply with any of the conditions imposed by Section 1 hereof shall render the President, Vice-President, General t-Ianager, Local Manager and Local Agent liable to the penalty prescribed in this Section. SECTION 3. THAT should any pa~agraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publi- cation of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
