TO-~·IIT: ZONE CASE NO. 2126; CHANGE A TRACT OF LAND OUT OF SECTION 28, BLOCK E-2, LUBBOCK COUNTY, TEXAS, FROM R-1 TO PLANNED UNIT DEVELOPMENT ON 40 ACRES OR MORE AND LIMITED TO R-1, R-2, A-1, A-2 AND AM USES SPECIFIC USE PERMIT; PROVIDING FOR CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, after rece1v1ng the recommendations of the Planning and Zoning Commission and after due notice and public hearing and all matters having been done and performed as required by Section 22 of Zoning Ordinance No. 7084 of the City of Lubbock (said Ordinance being an Appendix to the Lubbock City Code) relating to Specific Use Permits, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, morals, and general welfare to authorize the granting of the Specific Use Permit as hereinafter set forth; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the Director of Planning of the City of Lubbock is authorized to issue a Specific Use Permit to the Applicant in Zone Case No.2126 in accordance with the recommendations and conditions Imposed by the Planning and Zoning Commission, on file with the office of the Director of Planning and the City Council which are hereby adopted and incorporated herein by reference for all purposes, provided said Applicant agrees to be bound by the terms of the Specific Use Permit, the granting of which is hereby made subject to com- pi iance to all provisions of Zoning Ordinance No. ]084, an Ordinance of the City of Lubbock, including particularly, but not 1 imited to Section 22 of a Zoning Ordinance No. 7084, which provides that a Specific Use Permit and a Building Permit shall be applied for and secured within thirty-six (36) months of the effective date of the zone change or all undeveloped property shall automatically revert back to the previous zoning classification; and the Director of Planning in such event Is directed to remove from the Zoning Map the legend indicating such limited use. The specific use authorized by this Ordinance is permitted under provision of Section 22.3-l-2 of the Zoning Ordinance on the property respectively described below. ZONE CASE NO. 2126 Change a tract of land out of Section 28, Block E-2, Lubbock County. Texas, from R-1 to "Planned Unit Development on 40 Acres or More and limited to R-1, R-2, A-1, A-2 and AM Uses" specific use permit. This property is further described by metes and bounds as follows: BEGINNING at a point which bears South an approximate distance of 30.0 feet from the Northwest corner of the Northeast quarter of Section 28, Brock E-2, Lubbock County, Texas; THENCE South an approximate distance of 345.0 feet to a point of curvature; LGB :bsb THENCE Southeasterly, around a curve to the left, said curve having a radius of approximately 87.96 feet, and a chord distance of approximately 114.93 feet; THENCE . 544° 51' 30"E anapproximate distance of 585.00 feet; THENCE N45° 08' 3011 E anapproximate distance of 45.00 feet to a point of curvature; THENCE Northeasterly, around a curve to the right, said curve having an approximate radius of 164.23 feet, and an approximate chord distance of 136.05 feet; THENCE 589° 51 1 30"E · an approximate distance of 537.27 feet; THENCE South an approximate distance of 580.00 feet; THENCE West an approximate distance of 2452.04 feet; THENCE N20° 08 1 W an approximate distance of 1370.00 feet to a point of curvature; THENCE Northeasterly, around a curve to the right, said curve having a radiuso-fapproximately 15.00 feet, and a chord distance of approximately 21.21 feet,. a point of compound curvature; THENCE Northeasterly, around a curve to the right, said curve having a radius of approximately 300.00 feet, and a chord distance of 120.00 feet; THENCE East an approximate distance of 1665.00 feet to the PLACE OF BEGINNING. SUBJECT TO THE FOLLOWING CONDITIONS: l. That any future zone change requests on property within this Planned Unit Development shall result in the zoning on any remaining undeveloped property within this Planned Unit Development being reconsidered at that same time. 2. One A~l, R-2 or TH tract be developed before any A-2 orCA tract development. SECTION.2. THAT any person, firm or corporation owning or operating the subject property failing to comply with the conditions imposed by Section I hereof shall be guilty of a misdemeanor and upon conviction thereof shall be subject to a fine not to exceed TWO HUNDRED DOLLARS and each and every day•s violation thereof shall constitute a separate and distinct offense. The failure of any corporation owning or operating the subject property to comply with any of the conditions imposed by Section I hereof shall render the President, Vice-President, General t·1anager, Local Hanager and local Agent 1 iable to the penalty prescribed in this Section. · SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared uncons.titutional or invalid for any reason, the remainder of this Ordinance sha 11 not be a f fected thereby.
