HomeMy WebLinkAboutOrdinance - 7465-1977 - Ordinance Amending Zoning Ordinance No. 6462;Amending Condition No.5; Case 180-A - 06/26/1977\ LGB:bsb ORDINANCE NO. 3465 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 6462 OF THE CITY OF LUBBOCK BY AMENDING CONDITION NO. 5 MADE A PART THEREOF: ZONE CASE NO. 1807-A; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, The City Council finds that after all notices have been given and hearings held as provided by law, that it is in the best interest of the citizens of the City of Lubbock to make the change in the zoning law as herein after set forth; NOW THEREFORE : BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Zoning Ordinance No. 6462 of the Cit y of Lubbock BE and is hereby amended by amending Condition No. 5 made a part thereof to r ead as follows: 11Signs other than billboards shall be regulated by Ordinance No. 7084 (Comprehensive Zoning Ordinance) of the City of Lubbock. Billboards shall be prohibited, and any in existence on November 22, 1972, shall become legal non-conforming uses. Such uses may not be subjected to loss of non- conforming status within five (5) years of any involun- tary loss nor shall they be subject to amortization. Any billboards involuntarily lost on the part of the owner may be replaced or relocated or both without losing their non-conforming status, but only ifreplaced or relocated, or both, within five (5) years of their involuntary loss and only if such replacement or relo- cated billboard complies with the following requirements: (A) It shall be constructed to meet the construction standards as established in the City of Lubbock Building Code. (B) The maximum area of such billboard shall not exceed the area of the billboard involuntarily lost, as long as it is in the same zone. (C) There shall be a minimum separation of two hundred (200 1 ) feet between all billboards on the same side of the street. (D) It shall have a ft:ont setback of not less than the setback of that portion nearest to the street of the nearest building to the street located within twenty-five (25') feet of any portion of the billboard or, if there is no building within twenty-five (25') feet of any portion of the billboard, then the setback of the nearest building to the billboard, but in no event will the required setback exceed forty-three (43') feet. LGB:bsb (E) It shall have a maximum height of forty-five (45 ') feet. (F) The ~ighting on such billboard shall be so shielded as not to produce an intensive or excessive light or glare on adjacent property. Nothing in this provision shall be construed to allow any increase in the number of such legal non-conforming ·uses as they existed on November 22, 19 72." SECTION 2. THAT the amendment made in Section 1 hereinabove shall apply only to the property described therein covered by Ordinance No. 6462. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publi- cation of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
