ORDINANCE NO. 7445
AN ORDINANCE AUTHORIZING THE ISSUANCE OF A SPECIFIC USE PE~IIT, TO-WIT:
ZONE CASE NO. 2118; CHANGE A TRACT OF LAND OUT OF SECTION 15, BLOCK E-2, CITY
OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM R-1 TO PLhlfNED UNIT DEVELOPMENT
SPECIFIC USE PERMIT ON 160 ACRES OR MORE; PROVIDING FOR CONDITIONS; PROVIDING
A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, after receiving the recommendations of the Planning and Zoning
Commission and after due notice and public hearing and all matters having been
done and performed as required by Section 22 of Zoning Ordinance No. 7084 of
the City of Lubbock (said Ordinance being an Appendix to the Lubbock City Code)
relating to Specific Use Permits, the City Council finds that due to changed
conditions, it would be expedient and in the interest of the public health,
morals, and general welfare to authorize the granting of the Specific Use
Permit as hereinafter set forth; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the Director of Planning of the City of Lubbock is
authorized to issue a Specific Use Permit to the Applicant in Zone Case No.
2118 in accordance with the recommendations and conditions imposed by the
Planning and Zoning Commission, on file with the office of the Director of
Planning and the City Council which are hereby adopted and incorporated herein
by reference for all purposes, provided said Applicant agrees to be bound by
the terms of the Specific Use Permit, the granting of which is hereby made
subject to compliance to all provisions of Zoning Ordinance No. 7084, an
Ordinance of the City of Lubbock, including particularly, but not limited to
Section 22 of Zoning Ordinance No. 7084, which provides that a Specific Use
Permit and a Building Permit shall be applied for and secured within thirty-
six (36) months of the effective date of the zone change or all undeveloped
property shall automatically revert back to the previous zoning classification
and the Director of Planning in such event is directed to remove from the
Zoning Map the legend indicating such limited use. The specific use author-
ized by this Ordinance is permitted under provision of Section 23.3-1-4 of the
Zoning Ordinance on the property respectively described below.
ZONE CASE NO. 2118
Change a tract of land out of Section 15, Block E-2, City
of Lubbock, Lubbock County, Texas; from R-1 to Planned Unit
Development Specific Use Permit on 100 acres or more. This
property is further described by metes and bounds as follows:
BEGINNING at the Northwest corner of said Section 15,
Block E-2, Lubbock County, Texas;
THENCE East 2642.9 feet to a point;
THENCE South 2145.0 feet to a point;
THENCE East 2640.5 feet to a point in the East line
of said Section 15;

THENCE South along the east line of said Section 15, a
distance of 3138.0 feet to the Southeast corner of said
Section 15;
THENCE West along and with the South line of Section 15
a distance of 660.0 feet to a point;
THENCE North along the existing Lubbock City Limit line
and also being parallel to the East line of Section 15
a distance of approximately 2490.0 feet to a point;
THENCE West along the existing Lubbock City Limit line
a distance of approximately 4620.0 feet to a point in
the West line of said Section 15;
THENCE North along and with the West line of said Section
15 a distance of 2790.0 feet to the POINT OF BEGINNING of
the tract herein described and containing 246 acres more
or less.
SUBJECT TO THE FOLLOWING CONDITIONS:
1. Specific Use on the Golf Course ("GC") will have site plan review
before building permit issuance. One-third of the golf course
must be completed within 12 months. If not, then the Specific Use
period on all tracts will revert to 12 months from the effective
date of the ordinance, notwithstanding Sec. 22 of OrdinanceNo. 7084.
' 2. "A" zones will have "A-1" uses and standards and will be subject
to a detailed site plan review.
3. "CA" zones will have "CA" uses and standards and will be subject
to a detailed site plan review.
4. "C" zones will have "C-2" uses and standards and will be subject
to a detailed site plan review.
5. "TH11 tracts are subject to Section 22.3-2 of the Zoning Ordinance
pertaining to townhouses and subject to a detailed site plan review.
6. Approval of this zone case shall not be construed in any way
expressly or impliedly to constitute approval or disapproval
of any annexation which may be pending on that property included
on the plat approved in conjunction with this zone case.
SECTION 2. THAT any person, firm or corporation owning or operating
the subject property failing to comply with the conditions imposed by Section
hereof shall be guilty of a misdemeanor and upon conviction thereof shall be
subject to a fine not to exceed TWO HUNDRED DOLLARS and each and every day's
violation thereof shall constitute a separate and distinct offense.
The failure of any corporation owning or operating the subject property
to comply with any of the conditions imposed by Section 1 hereof shall render
the President, Vice-President, General Manager, Local Manager and Local Agent
liable to the penalty prescribed in this Section.
SECTION 3. THAT should any paragraph, sentence, clause, phrase or word
of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.

SECTION 4. THAT the City Secretary is hereby authorized to cause
publication of the descriptive caption of this Ordinance as an alternative
method provided by law.
