HomeMy WebLinkAboutOrdinance - 7421-1977 - Specific Use Permit, Zone Case 1794-D; Raintree Addition - 03/24/1977LGB:bsb ORDINANCE NO •_...;...7.....:..4=..:21=----- AN ORDINANCE AUTHORIZING THE ISSUANCE OF A SPECIFIC USE PERMIT, TO-WIT: ZONE CASE NO. 1794-D; CHANGE TRACT L; RAINTREE ADDITION, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM C-2 TO C-2 SPECIFIC USE PERMIT; PROVIDING ASAVING CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, after receiving the recommendations of the Planning and Zoning Commission and after due notice and public hearing and all matters having been done and performed as required by Section 22 of Zoning Ordinance No. 7084 of the City of Lubbock (said Ordinance being an Appendix to the Lubbock CityCode relating to Specific Use Permits, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, mo rals, and general welfare to authorize the. granting of the Specific Use Permits as hereinafter set forth; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the Director of Planning of the City of Lubbock is authorized to issue a Specific Use Permit to the Applicant in Zone Case No. 1794-D in accordance with the recommendations and conditions imposed by the Planning and Zoning Commission, on file with the office of the Director of Planning and the City Council which are hereby adopted and incorpor.uted herei by reference for all purposes, provided said Applicant agrees to b~ bound by the terms of the Specific Use Permit, the granting of which is hereby made subject to compliance to all provisions of Zoning Ordinance No. 7084, an Ordinance of the C~ty of Lubbock, including particularly, but not limited to Section 22 of Zoning Ordinance No. 7084, which provides that a Specific Use Permit and a Building Permit shall be applied for and secured within ~~irty­ six (36) months of the effective date of the zone change or all undeveloped property shall automatically revert back to the previous zoning classifica- tion; and the Director of Planning in such event is directed to re(IDVe from the Zoning Map the legend indicating such limited use . The specific use authorized by this Ordinance is permitted under provision of Section 22.3-13 of the Zon~ng Ordinance on the property respectively described below. ZONE CASE NO. 1794-D Change Tract L, Raintree Addition~ City of Lubbock, Lubbock County, Texas from C-2 to C-2 Specific Use Permit. SECTION 2. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby.
