ORDINANCE NO. 7418
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF
TilE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 2116;
CHANGE A TRACT OF LAND OUT OF SECTION 3, BLOCK A, CITY OF LUBBOCK, LUBBOCK
COUNTY, TEXAS, FROM R-1 TO M-1 ZONING DISTRICT; SUBJECT TO CONDITIONS; PROVID-
ING A PENALTY: PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, the proposed changes in zoning districts as hereinafter made
have been duly presented to the Planning and Zoning Commission for its reco~
mendation which was received by the City Council and, after due consideration,
the City Council finds that making the proposed changes as hereinafter set out
will be in the public interest; and, ·
WHEREAS, all conditions precedent required by law for a valid amendment
to the Zoning Ordinance and Map have been fully complied with, as well as
giving notices in compliance with Section 26 of Ordinance No. 7084, as well as
notices provided by Article 1011£, Vernon's Annotated Civil Statutes, amended
in 1961,and notice was duly published in the Lubbock Morning Avalanche-Journal
more than fifteen (15) days prior to the date of the public hearing before the
City Council on such proposed amendment, and the public hearing according to
said notice was duly held in the City Council Room on the second floor of the
City Hall, Lubbock, Texas, at which time persons appeared in support of the
proposal; and, after said hear~ng, it was by the City Council determined that
it would be in the public interes~ due to changed conditions, that the Zoning
Ordinance and the Zoning Map be amended in the manner hereinafter set forth ir
the body of this Ordinance and this Ordinance having been introduced prior to
first reading hereof; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and
the same are hereby amended as follows, to-wit:
ZONE CASE NO. 2116
Change a tract of land out of Section 3, Block A, City
of Lubbock, Lubbock County, Texas, from R-1 to M-1 zoning
district. This property is further described by metes
and bounds as follows:
BEGINNING at a 1/2" square tube set as the Southeast
corner of this tract and in the East line of the
Southwest quarter of said section~ from said tube
the Southeast corner of the Southwest quarter bears
S0°08' West a distance of 1650 feet;
THENCE S89°29'30" West a distance of 753.30 feet to
a 1/2" square tube set at the Southwest corner of
this tract in the Southeast right-of-way line of
the Idalou Highway;
THENCE N45 °59' East along said right-of-~'lay line, a
distance of 387.80 feet to a 1/2" square tube set
as the Northwest corner of this tract;

niENCE N89°29'301t East along the South line of
a tract recorded in Volume 356, Page 331, a dis-
tance of 265.30 feet to a 1/2" ro·d set as the
Southeast corner of said recorded tract:
THENCE N45°59' East along the East line of said
recorded tract, a distance of 90 feet to a 1/2"
square tube set as the Northeast corner of said
recorded tract;
THENCE N89°29'30" East a distance of 145.14 feet
to a 1/2" square tube set in the East line of the
Southwest quarter of said Section, for the North-
east corner of this tract;
THENCE S0°0·8' West along the East line of the
Southwest quarter of said section, at 6.45 feet
pass a 3/4u rod set in the South line of 1st
Street as recorded by Morning View Addition,
Installment #2, continuing for a total distance
of 328.95 feet to the PLACE OF BEGINNING.
SUBJECT TO THE FOLLOWING CONDITIONS:
1. That 2% landscap~ng and 43 foot setbacks be required.
2. That outside sto~age of raw materials be screened.
3. That outside sto~age of raw materials not be taller than
the screening fence.
SECTION 2. THAT from and after passage and effective date of this
Ordinance said ·lots, tracts and parcels of land described in Section 1 hereof
shall be changed to the zoning district indicated and the Official Map is
amended in accordance herewith.
SECTION 3. THAT any person, firm or corporation owning or operating th
subject property failing to comply with the conditions impos.ed by Section 1
hereof shall be guilty of a misdemeanor and upon conviction thereof, shall be
subject to a fine not to exceed TWO HUNDRED DOLLARS and each and every day's
violation thereof shall constitute a separate and distinct offense.
The failure of any corporation own~ng or operating the subject proper
to comply with any of the conditions imposed by Section 1 hereof shall render
the President, Vice-President, General Manager, Local Manager and Local Agent
liable to the penalty prescribed in this s'ection. · ·
SECTION 4. THAT should any section, paragraph, sentence, clause, phras
or word of this Ordinance be declared unconstitutional or invalid for any
reason, the remainder of this Ordinance shall not be affected thereby.

SECTION 5. THAT the City Secretary is hereby authorized to cause publi-
cation of the descriptive caption of this Ordinance as an alternative method
provided by law.
AND IT IS SO ORDERED
