AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOW - ING CHANGE: ZONE CASE NO. 1209-B: CHANGE A TRACT OF LAND OUT OF SECTION 8, BLOCK E-2. LUTHERAN ADDITION, CITY OF LUBBOCK, TEXAS FROM C-2 TO A-1 ZONING DISTRICT; SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed change in zoning districts as hereinafter made lhas been duly presented to the Planning and Zoning Commission for its recom7 mendation, which was received by the City Council and, after due consideration. the City Council finds that making the proposed change as hereinafter set out j ill be in the public interest; and, WHEREAS, all conditions precedent required by law for a valid amend ment to the Zoning Ordinance and Map have been fully complied with. as well as giving notices in compliance with Section 26 of Ordinance No. 7084 as well as notices provided by Article 1011f, Vernon's Annotated Civil Statutes, amen• - ed in 1961, and notice was duly published in the Lubbock Morn.ing Avalanche Journal more than fifteen (15) days prior to .the date of the public hearing be - fore the City Council on such proposed amendment, and the public hearing ac- cording to said notice was duly held in the City Council Room on the Second Floor of the City Hall, Lubbock. Texas, at which time persons appeared in support of the proposal; and, after said hearing. it was by the City Council determined that it would be in the public interest, due to changed conditions, l that the Zoning Ordinance and the Zoning Map be amended in the manner here- inafter set forth in the body of this Ordinance and this Ordinance having been (ntroduced prior to first reading hereof; NOW THEREFORE: 1BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map 1BE and the same are hereby amended as follows; to-wit: ZONE CASE NO. 1209-B Change a tract of land out of Section 8, Block E-2. Lutheran Addition, City of Lubbock, Texas from C-2 to A-1 Zoning District. Property is further described by metes and bounds to-wit: KJ:lb Portions of Lots 1, 2, 3, and 4, Lutheran Addition to the City of Lubbock, Lubbock County, Texas, and more particularly described in 3 parts as follows: PART I All of the South 260. 0 feet of Lots 3 and 4 being bound on the South by a 20 foot alley and on the North by the North line of a 50 foot easement recorded in Vol. 1180, p. 318- 3 21 of deed re cord; PART II The following described part of Lot 2; BEGINNING at the Southeast corner of Lot 2, thence North 260. 0 feet to a point; THENCE West along the North side of a 50 foot easement 90. O feet to a R.R. spike set; THENCE South 1 73. 0 feet to a 1 / 2" iron pipe set; THENCE West 64. O feet to a 1/211 iron pipe set; THENCE South 87. O feet to a 3/811 rebar found at the Southwest corner of Lot 2; THENCE East 154. O feet to the PLACE OF BEGINNING. PART III The following described part of Lot 1; BEGINNING at 3/811 rebar found at the Southeast corner of Lot 1, said rebar is also the Southwest corner of Lot 2; THENCE North 87. O feet to.a 1/2" iron pipe set; THENCE West 30. 0 feet to:a 1/211 iron pipe set; THENCE South 87. O feet to a 1/211 iron pipe set; THENCE East 30. O feet to the PLACE OF BEGINNING. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The construction of two-story units with walls containing windows shall be restricted to a minimum 50 feet setback from the property lines adjacent to any R-1 Zoning District. All other setbacks and building restrictions under the present Ordinance governing A-1 zoning would remain. SECTION 2. THAT from and after passage and effective date of this Ordinance said lots, tracts and parcels of land described in Section 1 hereof shall be changed to the Zoning District indicated and the Official Map is amend ed in accordance herewith. SECTION 3. THAT any person, firm or corporation owning or operat- ing the subject property failing to comply with the conditions imposed by Sec- ltion 1 hereof shall be guilty of a misdemeanor and upon conviction thereof, shall be subject to a fine not to exceed TWO HUNDRED DOLLARS and each an ' everyday' s violation thereof shall constitute a separate and distinct offense. The failure of any corporation owning or operating the subject propert f o comply with any of the conditions imp osed by Section 1 hereof shall render t he President, Vice-President, Gener al Manager, Local Manager and Local gent liable to the penalty prescribed in this section. SECTION 4. THAT should any section, paragraph, sentence, clause, hrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 5. THAT the City Secretary is hereby authorized to cause [publication of the descriptive caption of this Ordinance as an alternative me- ~hod provided by law.
