AN ORDINANCE AMENDING THE FY 2009-10 BUDGET FOR
MUNICIPAL PURPOSES RESPECTING THE GRANT FUND TO ACCEPT AND
APPROPRlATE FUNDING FROM THE TEXAS DEPARTMENT OF HOUSING
AND COMMUNITY AFFAIRS FOR THE WEATHERlZATION ASSISTANCE
PROGRAM; ACCEPT AND APPROPRIATE FROM THE TEXAS STATE
LIBRARY AND ARCHIVES COMMISSION FOR THE LOAN STAR LIBRARlES
GRANT; ACCEPT AND APPROPRIATE FROM 11-IE BROWN FOUNDATION
FOR A WEB-BASED CATALOG SYSTEM; AND RESPECTING THE CAPITAL
PROGRAM TO AMEND THE PUBLIC SAFETY CAPITAL PROGRAM TO
INCLUDE THE CAPITAL PROJECTS APPROVED IN THE 2009 BOND
ELECTION AS DETAILED IN EXHIBIT A; AND AMEND THE STREETS
CAPITAL PROGRAM BY ADDING THE CAPITAL PROJECTS APPROVED IN
THE 2009 BOND ELECTION AS DETAILED IN EXHIBIT B.
WHEREAS, Section 102.010 of the Local Government Code of the State of
Texas authorizes the City Council to make changes in the budget for municipal
purposes; and
WHEREAS, in accordance with the City Budget Ordinance the City Council
shall approve all transfers between funds and departments; and
WHEREAS, the City Council deems it advisable to change the FY 2009-10
Budget for municipal purposes and reallocate funds as follows; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the City Council of the City of Lubbock hereby approves
changes to the City of Lubbock Budget FY 2009-10 (Budget Amendment #5) for
municipal purposes, as follows:
I. Accept and appropriate $1,176,924 from the Texas Department of
Housing and Community Affairs for the Weatherization Assistance
Program from the American Recovery & Reinvestment Act.
II. Accept and appropriate $44,710 from the Texas State Library and
Archives Commission for the Loan Star Libraries Grant.
IlL Accept and appropriate $50,000 from the Brown Foundation for a
web-based catalog system.
IV. Appropriate $2,750,000 in the Public Safety Capital Program to
include a portion of the capital projects approved in the 2009 bond
election as detailed in Exhibit A.
V. Appropriate $13,605,000 in the Streets Capital Program to include a
portion of the capital projects approved in the 2009 Bond Election as
detailed in Exhibit B.
SECTION 2. THAT a copy of the changes made to the City of Lubbock
Budget pursuant to this Ordinance shall be filed with the City Secretary and Cowtty
Clerk of Lubbock as required by law.
SECTION 3. THAT should any section, paragraph, sentence, clause, phrase
or word of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.
