HomeMy WebLinkAboutOrdinance - 2007-O0035 - Amending Chapter 8 Code Of Ordinances - 04/12/2007First Reading April 12, 2007 Item No. 5.6 Second Reading April 26, 2007 Item No. 5.3 ORDINANCE NO. 2007-o0035 AN ORDINANCE AMENDING CHAPTER 8 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS) BY AMENDING THE LOCATION OF THE POLLING PLACE FOR VOTING PRECINCT NO. 119; PROVIDING THAT THE CHANGE MADE BY THIS ORDINANCE BE IN CORPORA TED INTO THE MAP OF THE VOTING PRECINCTS AND DISTRICTS OF THE CITY OF LUBBOCK; PROVIDING A SAVINGS CLAUSE; PROVIDING THAT ALL PORTIONS OF CHAPTER 8 NOT AMENDED SHALL REMAIN THE SAME; PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS) the City Secretary has been informed that the voting location for Voting Precinct No. 119 is not available for use in the upcoming election to fill a vacancy on the City CoWlcil; and WHEREAS, another voting location has been found within Voting Precinct No. 119 to the City, which location, Homeplate Diner. 7615 University Avenue, has heretofore been designated the polling place for Voting Precinct No. 119 by Supplemental Election Order; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT subsection 8-4(a) ofthe Code of Ordinances of the City of Lubbock, Texas, is hereby amended to read as follows with regard to the polling place for Voting District No. 119: "The voting place shall be Homeplate Diner, 7615 University Avenue." SECTION 2. THAT the voting place set out in this Ordinance shall be delineated on the current map denominated "City of Lubbock Voting Precincts/Districts Official Map.H A copy of said map is attached and made a part of this section as if fully copied herein in detaiL A copy of the original of such map shall be kept in the office of the City Secretary and shall be available for public inspection, and at each special and general city election, a true copy of said map shall be furnished by the City Secretary to each of the presiding judges of the voting precincts for such special or general city election. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT all portions of Chapter 8 not expressly amended by this Ordinance shall remain as they are. SECTION 5. THAT the City Secretary is hereby authorized and directed to cause publication of this Ordinance in its entirety following final passage by the City Council. SECTION 6. THAT this Ordinance shall be effective upon final passage. AND IT IS SO ORDERED. Passed by the City Council on first reading this 12th day of __ Ap~r_il __ __,, 2007.
