HomeMy WebLinkAboutOrdinance - 2009-O0042 - Ordinance Amending FY 2009-09 Budget; Abandoned Vehcle, Traffic Count System - 05/28/2009First Reading May 28, 2009 Itea No. 5.1 ORDINANCE NO. 2009-o0042 Second Reading June 11, 2009 Itea No. 5.1 AN ORDINANCE AMENDING THE FY 2008-09 BUDGET FOR MUNICIPAL PURPOSES RESPECTING THE ABANDONED MOTOR VEHICLE FUND BY APPROPRIATING FUND BALANCE TO COVER EXPENSES RELATED TO PROFESSIONAL SERVICES CHARGES FOR TOWING AND STORAGE OF ABANDONED VEHICLES; AMEND THE OPERATING BUDGET AND CAPITAL PROGRAM IN THE LUBBOCK POWER & LIGHT FUND AS RECOMMENDED BY THE ELECTRIC UTILITY BOARD ON MAY 6, 2009, AND AS APPROVED BY THE CITY COUNCIL IN A MEETING CONDUCTED PURSUANr TO SECTION 551.086 OF THE TEXAS GOVERNMENT CODE; RESPECTING THE GRANT FUND BY ACCEPTING AND APPROPRIATING $5,726 FROM THE TEXAS DEPARTMENT OF STATE HEALTH SERVICES FOR COMMUNITY PREPAREDNESS SECTION -BIOTERRORISM DISCRETIONARY FUND PROJECTS; AND RESPECTING THE CAPITAL PROGRAM TO CREATE A NEW PROJECT FOR A PERMANENT TRAFFIC COUNT STATION, AND TO AMEND THE 50TH STREET-SLIDE ROAD/ LOOP 289 PROJECT. WHEREAS, Section 102.010 of the Local Government Code of the State of Texas authorizes the City Council to make changes in the budget for municipal purposes; and WHEREAS, in accordance with the City Budget Ordinance the City Council shall approve all transfers between funds and departments; and WHEREAS, the City Council deems it advisable to change the FY 2008-09 Budget for municipal purposes and reallocate funds as follows; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the City Council of the City of Lubbock hereby approves changes to the City of Lubbock Budget FY 2008-09 (Budget Amendment #12) for municipal purposes, as follows: I. Appropriate $114,43 3 from the Abandoned Vehicle Fund Balance to cover expenses related to professional services charges for towing and storage of abandoned vehicles. IV. Establish a Capital Improvement Project by appropriating $36,000 for a pennanent traffic count station on Slide Road between 56th Street and South Loop 289 frontage road funded from the Lubbock Metropolitan Planning Organization. V. Amend Capital Improvement Project 9146, 50th Street-Slide Road/Loop 289, by appropriating an additional $100,000 for a total budget of $8,269,000. The funding source is 2003 General Obligation Bonds. SECTION 2. THAT a copy of the changes made to the City of Lubbock Budget pursuant to this Ordinance shall be filed with the City Secretary and County Clerk of Lubbock as required by law. SECTION 3. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby.
