ORDINANCE NO. 2009-o0022
AN ORDINANCE ABANDONING AND CLOSING A PORTION OF A 60-
FOOT DRAINAGE AND UTILITY EASEMENT LOCATED IN LOT 24·A, BLOCK
7, LYNDALE ACRES ADDITION, TO THE CITY OF LUBBOCK, LUBBOCK
COUNTY, TEXAS: AND MORE PARTICULARLY DESCRIBED IN THE BODY OF
THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE
OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND
CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR
PUBLICATION.
WHEREAS, the City CoWlcil finds that the easement portion as hereinafter
described in the body of this Ordinance is no longer needed for easement purposes and
for public use; and it would be in the public interest to close, vacate and abandon the
same for easement purposes and for public use, and it would be in the public interest to
close, vacate and abandon the same; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the easement portion as hereinafter described shall BE and
the same is hereby closed, vacated and abandoned for easement purposes and for public I use, such easement being more particularly described in the attached Exhibit "A".
I SECTION 2. THAT the City Engineer is hereby authorized and directed to mark
the official maps of the City of Lubbock to reflect said abandonment and closing,
showing the number of this Ordinance and the date of its final passage.
SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or
word of this Ordinance be declared Wlconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary of the City of Lubbock is hereby
authorized and directed to cause publication of the descriptive caption of this Ordinance
as an alternative method provided by law.
AND IT IS SO ORDERED.

Passed by the City Council on second reading this 9th day of April '2009.

METES AND BOUNDS DESCRIPTION of a portion of a 60 foot drainage and utility easement to be closed,
located within Lot 24-A, Block 7, Lyndale Acres Addition to the City of Lubbock, Lubbock County, according to the
map, plat, and/or dedication deed thereof recorded in Volume 6518, Page 68, Real Property Records of Lubbock
County, Texas, being further described as follows:
BEGINNING at a 1/2" iron rod with cap found in the South right·of-way line of 50th Street, at the original Northeast
corner of said Lot 24-A, Block 7, Lyndale Acres Addition;
THENCE S. 00°01'00" W ., along the Eastern limits of said Lot 24-A, a distance of 53.03 feet to mag nail with
washer found at a point of curvature;
THENCE Southwesterly, along a curve to the right, said curve having a radius of 596.93 feet, a central angle of
23°33'56", tangent lengths of 124.52, a chord distance of 243.79, and a chord bearing of S. 11 °47'58" W., to a
1/2" iron rod with cap found in the North line of a 20 foot alley at a point of intersection;
THENCE N. 66°25'04'' W., along the North line of said 20 foot alley, a distance of 7.94 feet to a 1/2" iron rod with
cap set;
THENCE N. 09°34'43" W., a distance of 30.40 feet to a mag nail with washer set at a point of intersection;
THENCE Northeasterly, along a curve to the left, said curve having a radius of 572.93 feet, a central angle of
21 °01 '12", tangent lengths of 106.29 feet, a chord distance of 209.01 feet, and a chord bearing of N. 10°31'36" E.,
to a mag nail with washer set at a point of intersection;
THENCE N. 00°01 '00" E., a distance of 53.03 feet to an "x" cut on concrete set in the South right-of-way line of
said 50th Street;
THENCE S. 89°59'00"E., along said South right-of-way line, a distance of 24.00 feet to the Point of Beginning.
Bearings relative to the South right-of-way line of 50th Street being previously recognized as S. 89°59'00" E.
