HomeMy WebLinkAboutOrdinance - 2009-O0007 - Amending FY 2008-09 Budget; Accept Funding From TXDOT For Vehicle Capital Etc. - 02/12/2009First Reading February 12, 2009 Itea No. 5.2 ORDINANCE NO. 2009~0007 Second Reading February 26, 2009 Item No. 5.1 AN ORDINANCE AMENDING THE FY 2008-09 BUDGET FOR MUNICIPAL PURPOSES RESPECTING THE GRANT FUND TO ACCEPT AND APPROPRlA TE GRANT FUNDING FROM THE TEXAS DEPARTMENT OF TRANSPORTATION FOR VEHICLE CAPITAL REPLACEMENT; TO ACCEPT AND APPROPRIATE GRANT FUNDING FROM THE FEDERAL TRANSIT ADMINISTRATION FOR PARKING LOT RENOVATIONS AND BUS WASH; TO ACCEPT AND APPROPRIATE GRANT FUNDING FROM THE TEXAS COMMISSION ON ENVIRONMENTAL QUALITY THROUGH THE SOUTH PLAINS ASSOCIATION OF GOVERNMENTS FOR REGIONAL SOLID WASTE PROJECTS; TO ACCEPT AND APPROPRIATE GRANT FUNDING FROM THE TEXAS DEPARTMENT OF STATE HEALTH SERVICES FOR INFECTIOUS DISEASE CONTROL UNIT/FLU LAB; AMEND THE OPERATING BUDGET AND CAPITAL PROGRAM IN THE LUBBOCK POWER AND LIGHT FUND AS RECOMMENDED BY THE ELECTRIC UTILITY BOARD ON JANUARY 27, 2008 AND AS APPROVED BY THE CITY COUNCIL IN A MEETING CONDUCTED PURSUANT TO SECTION 551.086 OF THE TEXAS GOVERNMENT CODE, AND RESPECTING THE CAPITAL PROGRAM TO ESTABLISH A PROJECT FOR THE DESIGN DEVELOPMENT PHASE OF THE YOUTH SPORTS COMPLEX, PHASE II. WHEREAS, Section 102.010 of the Local Government Code of the State of Texas authorizes the City Council to make changes in the budget for municipal purposes; and WHEREAS, in accordance with the City Budget Ordinance the City Council shall approve all transfers between funds and departments; and WHEREAS, the City Council deems it advisable to change the FY 2008-09 Budget for municipal purposes as follows; NOW, THEREFORE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the City Council of the City of Lubbock hereby approves changes to the City of Lubbock Budget FY 2008-09 (Budget Amendment #8) for municipal purposes, as follows: I. Accept and appropriate $2,001,000 from the Texas Department of Transportation for vehicle capital replacement. II. Accept and appropriate $574,200 from the Federal Transit Administration for parking lot renovations and the purchase of a bus wash. Ill. Accept and appropriate $36,389 from the Texas Commission on Environmental Quality through the South Plains Association of Governments for the purchase of a modular design fire-rated household hazardous waste storage building. IV. Accept and appropriate $5,900 from the Texas Department of State Health Services for Infectious Disease Control Unit/Flu Lab. V. Amend the operating budget and capital program in the Lubbock Power and Light Fund by transferring $333,000 from the operating fund balance to the capital program and reallocating $435,000 within the capital program as recommended by the Electric Utility Board on January 27, 2009 and as approved by the City Council in a meeting conducted pursuant to Section 551.086 ofthe Texas Government Code. VI. Establish a Capital Project and appropriate $208,250 for the design development phase for the Youth Sports Complex, Phase II. SECTION 2. THAT a copy of the changes made to the City of Lubbock Budget pursuant to this Ordinance shall be filed with the City Secretary and County Clerk of Lubbock as required by law. SECTION 3. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall be affected thereby.
