No. 5.1 AN ORDINANCE AMENDING THE FY 2008-09 BUDGET FOR MUNICIPAL URPOSES RESPECTING THE CAPITAL PROGRAM TO AMEND THE 50TH TREET: SLIDE ROAD TO LOOP 289 PROJECT, TO CREATE A NEW PROJECT OR MONITORING WELLS AT THE MUNICIPAL LANDFILL, TO AMEND THE EW FIRE STATION NO. 16 PROJECT-H6'ftr AND QUAKER, TO AMEND THE UBBOCK BUSINESS PARK BOULEVARD GATEWAY STREETS PROJECT, TO END THE ASH AVENUE -FM 1294 TO CR5800 GATEWAY STREETS ROJECT AND RESPECTING THE GRANT FUND TO ACCEPT AND PROPRIATE GRANT FUNDING FROM THE TEXAS DEPARTMENT OF OUSING AND COMMUNITY AFFAIRS FOR THE COMPREHENSIVE ENERGY SSISTANCE PROGRAM, TO ACCEPT AND APPROPRIATE GRANT FUNDING ROM THE TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS OR THE COMMUNITY SERVICES BLOCK GRANT. WHEREAS, Section 102.010 of the Local Government Code of the State of Texas authorizes the City Council to make changes in the budget for municipal purposes; d WHEREAS, in accordance with the City Budget Ordinance the City Council shall pprove all transfers between funds and departments; and WHEREAS, the City Council deems it advisable to change the FY 2008-09 udget for municipal purposes and reallocate funds as follows; NOW, THEREFORE, E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the City Council of the City of Lubbock hereby approves hanges to the City of Lubbock Budget FY 2008-09 (Budget Amendment #6) for unicipal purposes, as follows: I. Amend Capital Improvement Project 9146, 50th Street: Slide Road/Loop 289, by appropriating an additional $550,000 for right-of-way acquisition and the City's portion of construction costs. II. Establish a Capital Improvement Project by appropriating $500,000 for the installation of new monitor wells and the plugging of existing water wells at Caliche Canyon and the West Texas Regional Disposal Facility as required by the Texas Commission on Environmental Quality. IV(a) Amend Capital Improvement Project 92160, Lubbock Business Park Boulevard by appropriating an additional $6,115,000 for construction costs. IV(b) Amend Capital Improvement Project 92157, Ash Avenue-FM 1294 to CR5800 by reducing the current appropriation by $5.1 million. V. Accept and appropriate $1,667,437 from the Texas Department of Housing and Community Affairs for the Comprehensive Energy Assistance Program. VI. Accept and appropriate $378,264 from the Texas Department of Housing and Community Affairs for the Community Services Block Grant. SECTION 2. THAT a copy of the changes made to the City of Lubbock Budget pursuant to this Ordinance shall be filed with the City Secretary and County Clerk of Lubbock as required by law. SECTION 3. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. Project Justification The construction of the project will have federal funding assistance through TEA 21. Federal funding will cover 80% of the cost of design and construction. The City will be responsible for the right-of-way cost, utility relocation, and 20% of the design and construction costs. TxDOT will provide the design and administer construction. Project History The project was approved by Lubbock voters in the 1999 Bond Election and is on the MPO Jist of projects for federal funding assistance. TxDOT has provided the design and will administer the construction contract and inspection. The Environmental Assessment has been completed and approved by Federal Highway Administration. Construction plans have been completed by TxDOT. Right-of-Way acquisition is substantially complete and the City has possesion of all needed parcels. A property owner is challenging the value established on two parcels during condemnation proceedings. Utility relocation and adjustments are underway. TxDOT currently has the project on their December, 2008, bid Jetting list. City ROW agent has completed three ofthe five required resident relocations. Original funding of .S I 00,000 was appropriated in the FY 1998-99 Revised Budget. Additional funding of$1,337,000 was appropriated in the FY 1999-00 Budget, Ord. No. 10180, August 26, 1999. Additional funding of$1,600,000 was appropriated in FY 2000-01 budget, Ord. No. 2000-00050, September 7, 2000. Additional funding of$275,000 was appropriated in FY 2005-06 Budget, Ord. No. 2005-00106, September 8, 2005. Additional funding of$7,655,000 was appropriated in FY 2006-07 Budget, Ord. No. 2006-00098, September 13,2006. Additional funding of$1 ,500,000 was appropriated in FY 2007-08 Budget Amendment #7, Ord. No. 2008-00029, March 27, 2008. Reduced funding by $4,848,000, TXDOT funding, December 18, 2008. The funding for the project was reduced because the TXDOT portion will not flow through the capital project. Project includes asphalt construction and necessary drainage features. Project Justification The development of Rail Pon Park is progressing and construction of this road is needed for the continued development of the Business Park.
