HomeMy WebLinkAboutOrdinance - 2008-O0082 - Amending Chapter 19 Titled, "Parks, Recreation And Related Matters; Curfew - 09/11/2008First Reading September 11. 2008 Item No. 5.8 ORDINANCE NO. 2008-Q0082 Second Reading September 25, 2008 Item No. 5.20 AN ORDINANCE AMENDING CHAPTER 19 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, ENTITLED "PARKS, RECREATION AND RELATED MATTERS" TO PROVIDE FOR THE REVIEW AND APPROVAL BY THE CITY MANAGER OR HIS/HER DESIGNEE OF REQUESTS TO ENGAGE IN CERTAIN ACTIVITIES IN PUBLIC PARKS; AND TO CREATE A CONFORMING EXCEPTION TO THE CURFEW ESTABLISHED THEREIN FOR APPROVED CAMPING ACTIVITY. WHEREAS, City ordinance prohibits camping in any park within the city, except in designated areas; and WHEREAS, City ordinance establishes a curfew, making unlawful the entering or remaining on the premises of any city park between the hours of 12:00 midnight and 5:00a.m.; WHEREAS, City periodically receives requests for designation of camping areas for overnight camping in the city parks; and WHEREAS, no authority to make said designation has been delegated by the City Council to any city official; and WHEREAS, the City Council finds that the review and approval of requests for camping designations would be more efficiently and more timely processed if the Code of Ordinances expressly delegated authority to review and approve said requests to the City Manager or his/her designee; and WHEREAS, it is necessary to provide for conforming exceptions to the park curfew set forth in the Code of Ordinances for approved camping activity; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 19-1(5) of the Code of Ordinances of the City of Lubbock is hereby amended to read as follows: "(5) To camp in any park within the city, except at the places set apart and designated as grounds therefor by the city manager or his/her designee." SECTION 2. THAT Section 19-4 of the Code of Ordinances of the City of Lubbock is hereby amended to read as follows: "It shall be unlawful for any person, except authorized employees of the city or persons authorized by the city manager pursuant to Section 19-1(5) of the Code of Ordinances of the City of Lubbock, to enter into, or remain upon, or to be upon the premises of the Meadowbrook Golf Course or any public park or playground in the city, except Mackenzie Park, between the hours of 12:00 midnight and 5:00a.m." SECTION 3. THAT should any paragraph, section, sentence, phrase, clause, or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method of publication provided by law.
