AN ORDINANCE ADOPTING THE 2003 EDITION OF THE
INTERNATIONAL FIRE CODE PROVIDING FOR CERTAIN AMENDMENTS TO
SUCH CODE AND AMEND CERTAIN SECTIONS OF CHAPTER 11 OF THE
LOCAL ORDINANCE IN ORDER TO MEET LOCAL CONDITIONS; PROVIDING A
PENALTY; AND PROVIDING FOR PUBLICATION
WHEREAS, it is the opinion of the City Council that the best interests of the
citizens of the City of Lubbock would be served by adopting the 2003 Edition of the
International Fire Code with regard to meet local conditions;
WHEREAS, it is the opinion of the City Council that the best interests of the
citizens of the City of Lubbock would be served by amending certain Sections of Chapter
11 of the local ordinance with regard to meet local conditions; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-2.
SECTION 2. THAT Sec. 11-2 of the Code of Ordinances of the City of Lubbock,
is hereby amended to read as follows:
Sec. 11-2. Obstructions and trash in aUeys.
Within the incorporated city limits no person shall place, leave or cause to
be placed, left, or put any box, barrel or receptacle, or construct any frame, shed,
house or pen in any alley, nor place any trash, wood, paper or rubbish in any
alley.
SECTION 3. THAT Chapter 11 of the Code of Ordinances ofthe City of
Lubbock is hereby amended by deleting Sec. 11-3.
SECTION 4. THAT Sec. 11-3 of the Code of Ordinances of the City of Lubbock,
is hereby amended to read as follows:
Sec. 11-3. Explosive Materials.
Manufacture, possession, storage, sale, transportation and use of explosive
materials shall be in accordance with the Fire Code adopted herein.
SECTION 5. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-4 and the Section will be
reserved for future use.
SECTION 6. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-9.
SECTION 7. THAT Sec. 11-9 of the Code of Ordinances of the City of Lubbock,
is hereby amended to read as follows:
Sec.ll-9. Fire Lanes-Required.
Fire lanes shall be designated, designed, and maintained as specified by
Chapter 5, Section 503, of the Fire Code as amended in Sec. 11-83 of the Code of
Ordinances of the City of Lubbock.
SECTION 8. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-10 and the Section will be
reserved for future use.
SECTION 9. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-13.
SECTION 10. THAT Sec. 11-13 of the Code of Ordinances of the City of
Lubbock, is hereby amended to read as follows:
Sec. 11-13. Enforcement.
The Fire Chief or Police Chief or their duly authorized representatives are
hereby authorized to monitor fire lanes to detect obstructions and may issue
citations, remove and impound any vehicle obstructing said fire lane, or both.
SECTION 11. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-46 and the Section will be
reserved for future use.
SECTION 12. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-4 7.
SECTION 13. THAT Sec. 11-47 of the Code of Ordinances of the City of
Lubbock, is hereby amended to read as follows:
Sec. 11-47. Violation.
Any owner or occupant of any building, structure or premises or any
person responsible for the condition of any premises who refuses or fails to
comply with an order or direction of the fire marshal, given under the provisions
of this chapter, to remove or remedy a hazardous condition, or who violates any
provision of this chapter, shall be subject to a fine not exceeding two thousand

dollars ($2,000.00). Each day of failure to comply with such order or direction or
code provision shall constitute a separate offense.
SECTION 14. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-48.
SECTION 15. THAT Sec. 11-48 of the Code of Ordinances of the City of
Lubbock, is hereby amended to read as follows:
Sec. 11-48. Inspection; fire safety surveys.
It shall be the duty of the fire marshal or his designee to inspect or perform
a fire safety survey as often as may be necessary, but not less than once a year, all
buildings and premises, except the interiors of living quarters and private
dwellings, for the purpose of ascertaining and causing to be corrected any
conditions liable to cause fire, or to ascertain and discover any violations or
deficiencies of the provisions or intent of this division or any law or ordinance
affecting the fire hazard.
SECTION 16. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-49.
SECTION 17. THAT Sec. 11-49 of the Code of Ordinances of the City of
Lubbock, is hereby amended to read as follows:
Sec. 11-49. Fire Station Territories.
It shall be the duty of the chief of the fire department and the fire marshal
jointly to forthwith plat the city into "fire station territories" each containing a city
fire station, and submit such plat to the city manager for approval. Upon approval
of said plat by the city manager as submitted or as modified by him, it shall be the
duty of the chief of the fire department to conduct one interior and one exterior
survey per year at each commercial occupancy in the station territory by members
of the fire department employed in each territory, such fire safety surveys to be
made by Wliformed firemen at the time and in the manner designated and directed
by the chief of the fire department. Such surveys shall be made by carefully
viewing all premises in each territory both from the abutting street and abutting
alley. The chief of the fire department shall require such written reports from
surveying fire department personnel as will disclose commonly occurring fire and
life safety hazards and critical life safety hazards as defined in the General
Procedures Manual of the Lubbock Fire Department regarding safety surveys.
SECTION 18. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-50.

SECTION 19. THAT Sec. 11-50 of the Code of Ordinances of the City of
Lubbock, is hereby amended to read as follows:
Sec. 11-50. Notice by fire chief, fire marshal.
Whenever the chief of the fire department or frre marshal, after inspection
of any building or structure or premises in the city, fmds said building, structure
or premises to be an unsafe building as defined by the fire code, the fire chief or
fire marshal shall cause to be served a written notice on the owner or occupant or
person responsible to vacate the structure or abate the unsafe conditions in
accordance with the fire code and city ordinance.
SECTION 20. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-54.
SECTION 21. THAT Sec. 11-54 of the Code of Ordinances of the City of
Lubbock, is hereby amended to read as follows:
Sec. 11-54. Same--Penalty; vacating buildings.
In addition to the penalty imposed in this article of closing a building or
structure it shall be unlawful for any person to disobey, or fail to comply with the
order of the chief of the fire department or fire marshal or to use, occupy or
remain in any nonresidential building or structure, when the same has been
ordered closed, or to remain upon or use or permit the use of any such premises.
SECTION 22. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-71.
SECTION 23. THAT Sec. 11-71 of the Code of Ordinances of the City of
Lubbock, is hereby amended to read as follows:
Sec. 11-71. Code adopted.
The City of Lubbock hereby adopts, the International Fire Code, herein
known as the fire code, published by the International Code Council, 2003 edition
save and except such portions as are hereafter amended. The same are hereby
adopted and incorporated as fully as if set out in length herein and from and after
the passage of the ordinance adopting this section, the provisions thereof shall be
controlling within the limits of the City of Lubbock. The adoption of the
International Fire Code extends to Appendix B and C. A copy of which shall be
maintained in the office of the frre marshal, all such copies to be open to public
inspection during the business hours of the offices where they are maintained,
along with amendments thereto provided by ordinance.

SECTION 24. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-72.
SECTION 25. THAT Sec. 11-72 of the Code of Ordinances of the City of
Lubbock, is hereby amended to read as follows:
Sec. 11-72. Penalty.
Any person violating, or failing to comply with any provision of the fire
code, as adopted in this article, shall be deemed guilty of a misdemeanor and,
upon conviction thereof, shall be fined an amount not exceeding two thousand
dollars ($2,000.00).
SECTION 26. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-73.
SECTION 27. THAT Sec. 11-73 of the Code of Ordinances of the City of
Lubbock, is hereby amended to read as follows:
Sec. 11-73. Authority of fire marshal.
The Fire Marshal is hereby authorized to enforce the provisions of the fire
code and city ordinance and shall have the authority to render interpretations of
the fire code, and to adopt policies, procedures, rules and regulations in order to
clarify the application of its provisions. Such interpretations, policies, procedures,
rules and regulations shall be incompliance with the intent and purpose of this
code and shall not have the effect of waiving requirements specifically provided
for in the code.
SECTION 28. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-74.
SECTION 29. THAT Sec. 11-74 of the Code of Ordinances of the City of
Lubbock, is hereby amended to read as follows:
Sec. 11-74. Board of appeals-Appointment.
The City of Lubbock Building Board of Appeals, established by section 6-
19 of the Lubbock City Code, is hereby appointed the board of appeals for the fire
code, as adopted by this article. The board shall establish rules and regulations
for conducting its business and shall render all decisions and findings in writing to
the fire marshal, with a copy to the appellant.
SECTION 30. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-77.

SECTION 31. THAT Sec. 11-77 of the Code of Ordinances of the City of
Lubbock, is hereby amended to read as follows:
Sec. 11-77. Inspection; certificate of occupancy.
The fire marshal or building official may require a building to be inspected
for compliance with the fire code, as adopted by this article, prior to the issuance
of a certificate of occupancy. When, in the opinion of the fire marshal or building
official, a building must be so inspected by the fire marshal or his designated
representative prior to issuance of an occupancy certificate, such building shall
not be occupied prior to such final inspection as the fire marshal or building
official may deem necessary.
SECTION 32. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-78.
SECTION 33. THAT Sec. 11-78 of the Code of Ordinances of the City of
Lubbock, is hereby amended to read as follows:
Sec. 11-78. Conflicts.
Conflicts between any proVISIOns of this ordinance, the fire code or
building code shall be governed by the Administration chapters of the adopted
codes.
SECTION 34. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-79.
SECTION 35. THAT Sec. 11-79 of the Code of Ordinances of the City of
Lubbock, is hereby amended to read as foJlows:
Sec. 11-79. Overcrowding or Admittance Beyond Approved Occupant Load
or Capacity.
Overcrowding or admittance of any person beyond the approved occupant
load or capacity of a building or a portion thereof shall not be allowed. The
owner, manager or occupant in charge of the premises shall be responsible for the
accurate count of the number of people in the building, area or any portion
thereof. Selling or distributing tickets, in any fonn or fashion, beyond the
approved occupant load of an area where the event will be held shall not be
permitted.
SECTION 36. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-80.

SECTION 37. THAT Sec. 11 -80 of the Code of Ordinances of the City of
Lubbock, is hereby amended to read as follows:
Sec. 11-80. Overcrowding.
Whenever a condition exists where either there are more people in a
building, structure or portion thereof than have been authorized by the fire
marshal or persons are sitting and/or standing in locations that may obstruct or
impede the use of aisles, passages, corridors, stairways, exits or other components
of the means of egress, and the fire marshal determines that a threat exists to the
safety of the occupants thereby creating a violation of overcrowding, the
occupant, owner or manager in charge of the occupancy shall be deemed guilty of
a misdemeanor and, upon conviction thereof, shall be fined an amount not
exceeding two thousand dollars ($2,000.00)
SECTION 38. THAT Sec. 11-81 of the Code of Ordinances of the City of
Lubbock, is hereby amended to read as follows:
Sec. 11-81. Admittance Beyond Approved Occupant Load or Capacity.
Any occupant, owner or manager that has been found to allow admittance
in any room, building or space beyond the approved occupant load or capacity as
determined by the fire marshal and the Fire Code shall be deemed guilty of a
misdemeanor and, upon conviction thereof, shall be fined an amount not
exceeding two thousand dollars ($2,000.00). Each of the following will be
considered to be separate violations of the Fire Code in addition to the violation of
Overcrowding:
A. Admittance beyond the approved occupant load by 1 thru 50
occupants;
B. Admittance beyond the approved occupant load by 51 thru 100
occupants;
C. Admittance beyond the approved occupant load by 101 thru 250
occupants; or,
D. Admittance beyond the approved occupant load by 251 or more
occupants.
SECTION 39. THAT Sec. 11-82 of the Code of Ordinances of the City of
Lubbock, is hereby amended to read as follows:
Sec. 11-82. Permit and Service Fees
The following fees are established for permits and other activities of the
City Fire Department, Fire Marshal's Office.

Fire Investigative Report -$5
Bum Permit-$350
Tank Installation/Removal -$85

SECTION 40. THAT Sec. 11-83 of the Code of Ordinances of the City of
Lubbock, is hereby amended to read as follows:
The amendment of Section 503.3, of the 2003 International Fire Code,
entitled Marking, by the addition of Sections 503.3.1, 503.3.2, 503.3.3, and
503.3.4, to read as follows:
Section 503.3.1. Maintenance.
The owner or person in control of any building for which fire lanes have
been designated shall mark and maintain said fire lanes by painting stripes on the
surface of said roadways to designate the fire lane for fire apparatus in accordance
with the specifications of Section 505.3 and in such a manner so as to be visible to
a reasonably observant person.
Section 503.3.2. Specifications for Marking.
All required fire lanes shall be provided and maintained with fire lane
striping which consists of a six (6) inch wide red background stripe with four (4)
inch high white letters stating "FIRE LANE NO PARKING" or ''NO
PARKING FIRE LANE" to be painted upon the red stripe every forty ( 40) feet
along the entire length of the fire lane, showing the exact boundary of the fire
lane. The words "FIRE LANE NO PARKING" or "NO PARKING FIRE
LANE" must be grouped together as a phrase. Separating the words ''NO
P ARK.ING" and "FIRE LANE" spacing them forty ( 40) feet apart does not meet
the intention of this ordinance. Fire lane markings shall be upon the vertical
surface of the curb unless otherwise approved by the Chief.
Section 503.3.4. Alternate Signs Allowed or Required.
If the Chief or authorized representative determines that other means of
notice are ineffective to designate a fire lane, signs may be required by written
notice to the property owner. These signs shall be in accordance with the
requirements of the Texas Manual of Uniform Traffic Control Devices. When
required, these signs shall be erected and maintained bearing a red legend stating
.. No Parking Fire Lane" with letters of at least two inches (2H) in height on a

white reflectorized background at least twelve inches (12") wide by eighteen
inches (18") tall. Signs shall be permanently affixed to a stationary post and the
bottom of the sign shall be six feet, six inches (6'6") above the finished grade.
Signs shall be spaced not more than fifty feet (50') apart. Signs may be installed
on permanent buildings or walls as approved by the Chief or authorized
representative. Additional signs may also be required by written notice from the
Chief.
Section 503.3.3 Alternate Markings.
When, due to a building's particular use, the Chief determines that fire
lane markings are impractical. The words "LOADlNG ZONE/ NO PARKING",
painted black, may be substituted for the words "FIRE LANE/ NO PARKING",
and the six inch (6") red stripe, must be painted yellow, but all other provisions of
Chapter 5 shall apply.
The amendment of Section 506, of the 2003 International Fire Code, entitled
Key Boxes, by the addition of Sections 506.1.2:506.1.2 Approved.
When required by the fire department a KNOX lock box, KNOX padlock,
and/or KNOX key switch must be installed on any structure or gate at a location
approved by the fire department. The key box shall contain keys as required by
the code authority or his designee.
SECTION 41. THAT Sec. 11-84 of the Code of Ordinances of the City of
Lubbock, is hereby amended to read as follows:
The amendment of Section 903.3.1.2 of the 2003 International Fire Code,
entitled NFPA 13R sprinkler systems, by the addition of sub-section
903.3.1.2.2 Attics, to read as follows:
903.3.1.2.2. NFPA 13R sprinkler systems.
Required automatic sprinkler systems in Group R occupancies of four
stories or less may be hydraulically calculated within the dwelling units in
accordance with NFPA 13R and as amended by this code. Sprinkler protection
shall be provided throughout, including the means of egress, patios, bathrooms,
closets, balconies and attic spaces of combustible construction. Attic spaces of
combustible construction shall be protected with a dry-pipe system. Wet systems,
non-metallic piping or antifreeze loops will not be allowed in these attic spaces.
Exception: Attic sprinkler systems may be omitted in the attic
space:
1. If the attic spaces are separated in accordance with the IBC,
and,
2. There is adequate access to all portions of the building for
fire fighting apparatus, and,

3. The attic space does not contain powered and/or heat
producing equipment that in the opinion of the fire marshal
creates a possible hazard.
SECTION 42. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-86.
SECTION 43. THAT Sec. 11-86 of the Code of Ordinances of the City of
Lubbock, is hereby amended to read as follows:
Sec. 11-86. Deimitions.
All definitions for fireworks and fireworks displays will be taken from the
Occupations Code ofTexas, Chapter 2154, §2154.001.
SECTION 44. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-87.
SECTION 45. THAT Sec. 11-87 of the Code of Ordinances of the City of
Lubbock, is hereby amended to read as follows:
Sec. 11-87. Exceptions to Applicability of this ordinance.
This article does not apply to the exemptions f01md in the Occupations Code of
Texas, Chapter 2154, §2154.002.
SECTION 46. THAT Sec. 11-88 of the Code of Ordinances of the City of
Lubbock, is hereby amended to read as follows:
Sec. 11-88. Possession, sale, etc., generally.
No person may manufacture, sell or give away fireworks, or store, possess or use
fireworks, unless:
(1) The fireworks are stored, possessed or used for public display
purposes and not for promotional or advertising purposes; and
(2) The requirements of this article are satisfied.
SECTION 4 7. THAT Sec. 11-89 of the Code of Ordinances of the City of
Lubbock, is hereby amended to read as follows:
Sec. 11-89. Penalty; seizure.
Violation of the provisions of this article is a misdemeanor punishable by
a fine not exceeding one thousand dollars ($1,000.00), and in addition the fire
marshal or fire chief may seize, remove or cause to be seized or removed those

fireworks offered or exposed for sale or stored or possessed or transported in
violation ofthis Code.
SECTION 48. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-101.
SECTION 49. THAT Sec. 11-101 of the Code of Ordinances of the City of
Lubbock, is hereby amended to read as follows:
Sec. 11-101. Storage, use and handling of explosives, fireworks and
pyrotechnic materials.
Storage, use and handling of fireworks and pyrotechnic special effects
materials shall be in accordance with the Fire Code and as required by state
regulations listed under the Occupations Code of Texas, Chapter 2154.
SECTION 50. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-1 03.
SECTION 51. THAT Sec. 11-103 of the Code of Ordinances of the City of
Lubbock, is hereby amended to read as follows:
Sec. 11-103. Permit fee.
The permit fee for a the display of fireworks, including proximate
audience displays and pyrotechnic special effects in motion picture, television,
theatrical, and group entertainment productions shall be one hundred fifteen
dollars ($115.00) for each proposed public display or five hundred dollars
($500.00) for an annual permit. The fire marshal or frre chief shall have the
authority to revoke a permit under this article if the permittee fails to pay such
permit fee upon application for such permit.
SECTION 52. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-113.
SECTION 53. THAT Sec. 11-113 of the Code of Ordinances of the City of
Lubbock, is hereby amended to read as follows:
Sec. 11-113. Transportation generally.
It shall be unlawful for any person to transport or move petroleum
products or petroleum products tank trucks, tank trailers or tank semi-trailers,
loaded, empty or partly loaded, within the city limits, other than on the approved
hazardous materials transportation routes as listed in Chapter 16, Art. II, Div. 2,
except that tank trucks, tank trailers and tank semi-trailers may use other streets in
said city limits for transportation of petroleum products when on the shortest route

between the approved hazardous material transportation routes and an established
wholesale or bulk storage business and except when making local delivery in
accordance with section 11-114 of this Code.
SECTION 54. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11 -161 .
SECTION 55. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-162.
SECTION 56. THAT Sec. 11-162 of the Code of Ordinances of the City of
Lubbock, is hereby amended to read as follows:
Sec. 11-162. Permit and license.
No person shall install any tank, container or equipment for the storing or
consumption of liquefied petroleum gas, or install any piping for the distribution
or use of liquefied petroleum gas, on any premises within the city, until such
person shall have secured a permit from the Fire Marshal's office of the city and
shall be regularly licensed by the Texas Railroad Commission in accordance with
the provisions of the Texas Administrative Code, Article 16 Part 1, Chapter 9. No
permit shall be issued unless the proposed installation complies with the Texas
Railroad commission and the Fire Code or a variance granted by the building
board of appeals. Permits will not be approved when the requested location is in
close proximity to a natural gas supply line or in residential areas where the tank
installation or the refilling process would pose a danger to the surrounding
occupancies. Any permit denial may be appealed to the building board of appeals.
SECTION 57. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-231.
SECTION 58. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-233.
SECTION 59. THAT Sec. 11-233 of the Code of Ordinances of the City of
Lubbock, is hereby amended to read as follows:
Sec. 11-233. Licenses and certificates of compliance-Required.
It shall be unlawful for any person to engage in the fire extinguisher
service business within the corporate limits of the city without first meeting the
requirements of the ''Texas Insurance Code, Article 5.43-1, Fire Extinguishers &
28 TAC §§ 34.500 the Fire Extinguisher Rules." It shall be unlawful for any
person to act, within the corporate limits of the city, as an agent, employee or
representative of any person engaged in the fire extinguisher service business
without being licensed by the state.

SECTION 60. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-234.
SECTION 61. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-235.
SECTION 62. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-236.
SECTION 63. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-237.
SECTION 64. THAT Chapter 11 of the Code of Ordinances of the City of
Lubbock is hereby amended by deleting Sec. 11-238.
SECTION 65. THAT should any section, paragraph, sentence, clause, phrase or
word of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.
SECTION 66. THAT the City Secretary is hereby authorized and directed to
cause publication of the descriptive caption of this Ordinance as an alternative
method of publication provided by law.

FISCAL IMPACT
As proposed, the docwnent contains provisions for an increase in plan review
fees from 15% to 25% of total permit fees, applicable to commercial reviews
only; and provides fees for subsequent post-permitting reviews of change
orders and other amendments to construction documents.
The Building Board of Appeals and the Building Inspection Department both
recommended approval.
Steven O'Neal, Building Official, gave comments and answered questions
from Council.
Motion was made by Council Member Gilbreath, seconded by Council
Member Boren to pass on first reading Ordinance No. 2005-00140 with an
amendment to exclude the language that refers to registration of
subcontractors. Motion carried: 6 Ayes, 0 Nays.
5.2. International Fire Code Ordinance 1st Reading -Fire Department:
Ordinance No. 2005-00141 adopting the 2003 Edition of the
International Fire Code providing for certain amendments to such code
and amend certain sections of Chapter 11 of the local ordinance in order
to meet local conditions; providing a penalty; and providing for
publication.
The current adopted Fire Code is the 1991 edition. The most current published
Fire Code is the 2003 International Fire Code. This new code is the
companion document to the 2003 International Building Code. The provisions
of this ordinance will not affect the International Residential Code that is
currently adopted. The Fire Department has worked several years through
several different code cycles attempting to get a current fire code adopted.
Code of Ordinances Chapter 11 was analyzed by the Ordinance Review
Committee and all amendments and changes to Chapter 11 and the adoption
of the 2003 International Fire Code were recommended to City Council by the
Committee. Meetings and reviews by the Building Official and Fire MarshaPs
Office were held with the Building Code Review Committee and areas of
concern were discussed and addressed.
Staff recommended approval of the first reading of this ordinance.
Motion was made by Council Member Gilbreath, seconded by Council
Member Price to pass on first reading Ordinance No. 2005-00141 as
recommended by staff. Motion carried: 6 Ayes, 0 Nays.
5.3. Contract Resolution -Fire Department: Resolution No. 200S-R0553 to
repair a fire pumper truck.
This item authorizes original equipment manufacturer trained service
technicians to perform exterior bodywork and repairs to all affected internal
engine and structural cab components of a fire pumper truck for the Fire
Department.
