HomeMy WebLinkAboutOrdinance - 2008-O0014 - Amending Section 16, Article VII; Establish Resident Parking Only; C - 02/14/2008First Reading February 14, 2008 !tea No. 5.13 ORDINANCE NO. 2008-o0014 Second Reading February 28, 2008 !tea No. 5.21 AN ORDINANCE AMENDING SECTION 16, ARTICLE VII, OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO THE ESTABLISHMENT OF A RESIDENT PARKING ONLY PROGRAM WITHIN SPECIFIED PORTIONS OF THE CITY; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council of the City of Lubbock heretofore established a test program in 1998 for residential parking permits for specified zones within the City of Lubbock; and WHEREAS, it is the finding of the City Council that the designation and enforcement of such zones has been successful and has reduced hazardous traffic conditions, protected neighborhoods from polluted air, excessive trash and refuse, provided better access for residents to their homes, preserved the residential character of such areas, promoted efficiency in the maintenance of public streets in a clean and safe condition and protected the health and safety of children in residential areas; and WHEREAS, the City Council of the City of Lubbock deems it to be in the best interests of the health, safety and welfare of the citizens of the City of Lubbock to expand the number of locations requiring residential parking permits on City streets in specified zones within the City of Lubbock; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 16-194, Code of Ordinances of the City of Lubbock, Texas, is hereby amended to read as follows: Sec. 16-194. PURPOSE AND ALLOWABLE LOCATIONS. The purpose of this article is to implement a "Resident Parking Only Program" for residential streets in specified zones within portions of the City of Lubbock for the following reasons: 1) To reduce hazardous traffic conditions caused by the use of residential streets for parking be persons using adjacent educations, commercial, industrial, or commuter facilities, but who do not reside in the neighborhood; 2) To protect the residents of such neighborhoods form polluted air, excessive noise, trash and refuse; 3) To protect the residents from unreasonable burdens in gaining access to their residences; 4) To preserve the character of such residential districts; 5) To promote efficiency in maintenance of the streets in a clean and safe condition; 6) To protect the safety of children in such residential areas. The allowable locations for the "Resident Parking Only Program" shall be limited to six (6) residential zones defined as follows: Zone Zone Boundary Area Number Name ZONE 1 Tech Terrace North: 19th Street (US 62 I SH 114) Neighborhood South: 34th Street East: University Avenue West: Indiana Avenue ZONE2 Heart of North: 19th Street (US 62 I SH 114) Lubbock South: 341h Street East: A venue Q (US 84) West: University A venue ZONE3 South Overton North: Broadway South: 191h Street (US 62 I SH 114) East: A venue Q (US 84) West: University Avenue ZONE4 North Overton North: Marsha Sharp Freeway (US 82)1 4th Street South: Broadway East: A venue Q (US 84) West: University Avenue ZONE5 Arnett Benson North: Clovis Road (US 84) South: Marsha Sharp Freeway (US 82)1 4th Street (FM 2255) East: University Aenue West: Indiana A venue Zone6 Monterey North: 42°0 Street High South: 501h Street East: Elgin A venue West: Indiana A venue The Citizens' Traffic Commission shall be charged with monitoring the effectiveness of this program and may request review by the Council of the City of Lubbock as necessary. 2 The City Council may continue, modify or repeal this ordinance, as may be desirable following any such review. SECTION 2. THAT violation of any provision of this Ordinance shall be deemed a misdemeanor punishable as provided by Section 1-4 of the Code of Ordinances of the City of Lubbock. SECTION 3. THAT should any paragraph, section, sentence, phrase, clause, phrase of word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method of publication as provided by law.
