HomeMy WebLinkAboutOrdinance - 2008-O0013 - Repelaing Ordinances 2006-00013 And 2007-000084 Pertaining; Signal Enforcement - 02/14/2008First 'Reading February 14~ 2008 Itea No. 6.4 ORDINANCE NO. 2008-o0013 Second Reading February 28, 2008 Ite11 No. 5.20 AN ORDINANCE REPEALING CITY OF LUBBOCK ORDINANCES NO. 2006-00131 AND 2007-00084 PERTAINING TO ESTABLISHMENT OF AN AUTOMATED TRAFFIC SIGNAL ENFORCEMENT SYSTEM FOR THE CITY OF LUBBOCK; DIRECTING REMOVAL OF THE EQUIPMENT REQUIRED FOR SUCH PROGRAM; PROVIDING A SAVING CLAUSE; PROVIDING AN ' EFFECTIVE DATE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City of Lubbock has heretofore established an automated traffic signal enforcement program utilizing cameras for certain intersections within the City; and WHEREAS, an engineering and traffic study of such intersections since implementation of said automated traffic signal enforcement program has been conducted and the study presented to the Red Light Traffic Signal Enforcement Committee and the Citizens Traffic Commission; and WHEREAS, said Red Light Traffic Signal Enforcement Committee and Citizens Traffic Commission have studied said program and have submitted independent reports on the automated traffic signal enforcement system; and WHEREAS, the City Council of the City of Lubbock after receiving said reports has determined that it would be in the best interest of the health, safety and welfare of the citizens of the City of Lubbock to terminate said automated traffic signal enforcement program; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK; SECTION 1: THAT Ordinances No. 2006-00131 and 2007-00084 establishing an automated traffic signal enforcement system for the City of Lubbock, BE and are hereby REPEALED. SECTION 2. THAT the City Manager and City staff are hereby ordered and directed to take such actions as may be necessary to terminate the automated traffic signal enforcement program and for removal of the cameras and other equipment appurtenant to said program. SECTION 3. THAT should any paragraph, section, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT this Ordinance shall be effective immediately upon passage by the City Council. SECTION 5. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method of publication provided by law. AND IT IS SO ORDERED. Passed by the City Council on first reading this 14th day of February , 2008. Passed by the City Council on second reading this 28th day of February , 2008.
