Qty of Lubbock ORDINANCE NO. 2007-00124 Second Reading December 14, 2007 Item No. 5.3 AN ORDINANCE ABANDONING AND CLOSrNG CERTAIN UNDERGROUND UTILITY EASEMENTS; SEWER LINE EASEMENT; TRANSFORMER PAD EASEMENTS; ALL OF SAID EASEMENTS BEING LOCATED IN 1RACT C-1, TRACT D-1, AND TRACT H-1, BRYAN PARK ADDITION, AS SHOWN ON PLAT WlTH DEDICATION DEED RECORDED IN VOLUME 1814, PAGE 335, AND VOLUME 1803, PAGE 937, DEED RECORDS OF LUBBOCK COUNTY, TEXAS; AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the easements as hereinafter described in the body of this Ordinance are no longer needed for easement pwposes and for public use; and it would be in the public interest to close, vacate and abandon the same for easement purposes and for public use, and it would be in the public interest to close, vacate and abandon the same; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. IHA T the easements as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for easement purposes and for public use, such easements being more particularly described as follows: TRACT C-1, BRYAN PARK ADDITION Four Foot by Six Foot (4' X 6') Transformer Pad Easement granted to SOUTHWESTERN PUBLIC SERVICE COMPANY on the South boundary of the Property, as shown on Plat with Dedication Deed, recorded in Volume 1814, Page 335, Deed Records of Lubbock County, Texas. Ten Feet (IO') of a Twenty Foot (20') Underground Utility Easement along the East boundary of the Property, as shown on Plat with Dedication Deed, recorded in Volume 1814, Page 335, Deed Records of Lubbock County, Texas. TRACT D-1, BRYAN PARK ADDITION Ten Feet (10') of a Twenty Foot (20') Underground Utility Easement along the West boundary of the Property, as shown on Plat with Dedication Deed, recorded in Volume 1814, Page 335, Deed Records of Lubbock County, Texas. Fifteen Foot (15') Sewer Easement along the North boundary of the Property, as shown on Plat with Dedication Deed, recorded in Volume 1814, Page 335, Deed Records of Lubbock County, Texas. Ten Foot (IO') Underground Utility Easement and Transformer Pad Easement granted to SOUTHWESTERN PUBLIC SERVICE COMP ANY along the East boundary of the Property, as shown on Plat with Dedication Deed, recorded in Volwne 1814, Page 335, Deed Records of Lubbock County, Texas. TRACT H-1, BRYAN PARK ADDITION Ten Foot (10') Underground Utility Easement along the West boundary of the Property, as shown on Plat with Dedication Deed, recorded in Volume 1803, Page 937, Deed Records of Lubbock County, Texas. Ten Foot (1 O') Underground Utility Easement along the North boundary of the Property, as shown on Plat with Dedication Deed, recorded in Volume 1803, Page 937, Deed Records of Lubbock County, Texas. Blanket Transformer Pad Easement and Underground Utility Easement granted to LUBBOCK POWER AND LIGHT COMPANY and SOUTHWESTERN PUBLIC SERVICE COMPANY, as shown on Plat with Dedication Deed, recorded in Volume 1803, Page 937, Deed Records of Lubbock County, Texas, INSOFAR AND ONLY INSOFAR AS SAID BLANKET EASEMENT COVERS OR INCLUDES TRACT H-1, BRYAN PARK ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
