HomeMy WebLinkAboutOrdinance - 2010-O0077 - Closing All Street And Alley Rights Of Ways Coronado Addition. - 09/27/2010Coltnter Filing First Reading September 27, 2010 Item No. 5.10 File and Return to Dave Booher R.O.W. ....City of Lubbock Second Reading October 14, 2010 Item No. 5.6 II ORDINANCE NO. 2010-00077 AN ORDINANCE ABANDONING AND CLOSING ALL STREET AND ALLEY RIGHTS~OF-WAY WITHIN LOT 1, BLOCK 37, CORONADO ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRlBED IN THE BODY OF THIS ORDINANCE: DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATON. WHEREAS, the City Council fmds that the streets and alleys as hereinafter described in the body ofthis Ordinance are no longer needed for street and alley purposes and for public use; and it would be in the public interest to close, vacate and abandon the same for street and alley purposes and for public use; and it would be in the public interest to close, vacate and abandon the same; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the streets and alleys as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for street and alley purposes and for public use, such street and alley portions being more particularly described in the attached as follows: Any and all previously dedicated street and alley rightswofwway which lie within the limits of Lot 1, Block 37, Coronado Addition to the City of Lubbock. Lubbock County, Texas according to the map, plat, and/or dedication deed thereof recorded in Volume 930, Page 182, Deed Records of Lubbock County. Texas. Specifically EXCLUDED from this request are those utility easements pre\iously granted by the plat of Lot 1, Block 37, Coronado Addition. Also EXCLUDED is the overhead power line easement granted in Volume 1185, Page 32 L Deed Records of Lubbock County. Texas. These easements are to remain in effect after the streets have been closed. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing. showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT shou ld any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason. the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
