ORDINANCE NO. 2001-00101
AN ORDINANCE ABANDONING AND CLOSING A 20-FOOT
TEMPORARY UTILITY EASEMENT AND A 20-FOOT TEMPORARY GARBAGE
COLLECTION AND A PUBLIC ACCESS EASEMENT LOCATED IN TRACT 19,
OVERTON PARK ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY,
TEXAS AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS
ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL
MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING;
PROVIDING A SA VIN GS CLAUSE; AND PROVIDING FOR PUBLICATION.
WHEREAS, the City Council finds that the easement portion as hereinafter
escribed in the body of this Ordinance are no longer needed for easement purposes and
or public use; and it would be in the public interest to close, vacate and abandon the
same for easement purposes and for public use, and it would be in the public interest to
lose, vacate and abandon the same; NOW THEREFORE:
E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION I. THAT the easement portions as hereinafter described shall BE and
he same is hereby closed, vacated and abandoned for easement purposes and for public
se, such easement portions being more particularly described in attached Exhibit "A"
d "B".
SECTION 2. THAT the City Engineer is hereby authorized and directed to mark
he official maps of the City of Lubbock to reflect said abandonment and closing,
ho wing the number of this Ordinance and the date of its final passage.
SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or
ord of this Ordinance be declared unconstitutional or invalid for any reason, the
emainder of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary of the City of Lubbock is hereby
uthorized and directed to cause publication of the descriptive caption of this Ordinance
s an alternative method provided by law.

METES AND BOUNDS DESCRIPTION for a 3,300 square foot portion of Tract 19, Overton Park, addition to the
City of Lubbock, Lubbock County, Texas, being that 20' Temporary Utility Easement recorded in Instrument No.
2007025570, Official Public Records of Lubbock County, Texas, and being further described as follows:
BEGINNING at a 1/2" iron pipe found in the South right-of-way line of ih Street, for the Northwest corner of Lot 1,
Block 113, Overton Addition to the City of Lubbock, Lubbock County, Texas, according to the map, plat and/or
dedication deed thereof recorded in Volume 18, Page 610, Deed Records of Lubbock County, Texas;
THENCE S. 00°06'33" E., a distance of 165.03 feet to a 1/2" iron rod with cap found for the Southwest corner of
Lot 3, Block 113, said Overton Addition;
THENCE S. 89°55'54" W., a distance of 20.00 feet to a point for the Southeast corner of Lot 8, Block 113, said
