No. 5.33 AN ORDINANCE AMENDING CHAPTER 8 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, BY AMENDING THE LANGUAGE OF SECTION 8-4 WITH REGARD TO VOTING PRECINCTS AND VOTING PLACES AS A RESULT OF ANNEXATIONS; ASSIGNMENT OF NEW VOTING PRECINCTS TO CITY COUNCIL DISTRICTS TO REFLECT THE CHANGES MADE BY SAID ANNEXATIONS; PROVIDING NEW VOTING PLACES WHERE NECESSARY DUE TO ANNEXATIONS AND LOSS OF PRIOR WCATIONS; PROVIDING A MAP OF THE VOTING PRECINCTS AND DISTRICTS OF THE CITY OF LUBBOCK; PROVIDING A SAVINGS CLAUSE; PROVIDJNG THAT ALL PORTIONS OF CHAPTER 8 NOT AMENDED SHALL REMAIN THE SAME; PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTNE DATE. WHEREAS, the City of Lubbock has completed four annexations during the past year and such annexations, including the corresponding changes to the voting precincts and voting districts and establishment of polling places have been submitted to and approved by the U.S. Department of Justice; and WHEREAS, the City Council of the City of Lubbock deems it to be in the best interest of the citizens of the City of Lubbock to conform its Voting Precinct and District descriptions and polling places to incorporate changes resulting from said annexations; and WHEREAS, said annexations, loss of voting places and availability of newly constructed schools for polling places require changes to some existing permanent polling places; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT subsection 8-4(a) of the Code of Ordinances of the City of Lubbock, Texas, is hereby amended to read as follows with regard to the following named Voting Precincts: Voting Precinct No. 52. Beginning at the intersection of Indiana Avenue and 82nd Street; thence east along 82nd Street to its intersection with University Avenue; thence south along University Avenue to its intersection with 981h Street; thence east along 98th Street to its intersection with Avenue P; thence south alon~ Avenue P to a point 1320 feet south of the intersection of the centerlines of 98 Street and Avenue P; thence west along a line 1320 feet south of the centerline of 98th Street to a point 1320 feet south and 2640 feet east of the intersection of the centerlines of 98th Street and University Avenue; thence south along a line 2640 feet west of the centerline of University Avenue to a point 2640 feet south and 2640 feet east of the intersection of the of the centerfines of 981h Street and University Avenue; thence west along a line 2640 feet south of the centerline of 98th Street to a point 2640 feet south and 660 feet west of the intersection of the centerlines of 98th Street and University Avenue; thence south along a line 660 feet east of the centerline of University Avenue its intersection with 1141h Street; thence west along 1141h Street to its intersection with Indiana; thence north along Indiana Avenue to the point of beginning. The voting place shall be Lubbock-Cooper North Elementary School. Voting Precinct No. 133. Beginning at the intersection of Quaker Avenue and 114 th Street: thence east along 114 tli Street to a point 660 feet east of the intersection of the centerlines of University Avenue and 114th Street; thence south along a line 660 feet east of the centerline of University Avenue to a point 660 feet east and 660 feet south of the intersection of the centerlines of 114 th Street and University Avenue; thence west along a line 660 feet south of the centerline of 1141h Street to a point that is 2640 feet east and 660 feet south of the intersection of the centerlines of Indiana Avenue and 1141h Street; thence south along a line 2640 feet east of the centerline of Indiana Avenue to a point 3288 feet south and 2640 feet east of the intersection of the centerlines of Indiana Avenue and 114th Street; thence west along a line 3288 feet south of the centerline of114th Street to a point 3288 feet south and 2147 feet east of the intersection of the centerlines of Indiana Avenue and 1141h Street; thence south along a line 214 7 feet east of the centerline of Indiana Avenue to a point 660 feet south and 214 7 feet east of the intersection of the ce nterl ines of Indiana Avenue and 1301h Street; thence west along a line 660 feet south of the centerline of 130th Street to its intersection with Quaker Avenue; thence north along Quaker Avenue to the point of beginning. The voting place shall be 1st Assembly of God Church. Voting Precinct No. 135. Beginning at a point 150 feet west of the intersection of the centerlines of Erskine Street and North Milwaukee Avenue; thence south along a line 150 feet west of the centerline of North Milwaukee Avenue to a point 660 feet south and 150 feet west of the intersection of the centerlines of Erskine Street and North Milwaukee Avenue; thence west along a line 660 feet south of the centerline of Erskine Street to a point 1171 feet east and 660 feet south of the intersection of the centerlines of Erskine Street and North Milwaukee Avenue; thence north along a line 1171 west of the centerline of North Milwaukee Avenue to a point 3019 feet north and 1171 feet west of the intersection of the centerlines of North Milwaukee Avenue and Erskine Street; thence east along a I in e 30 19 feet north of the centerline of E rs kine Street to a point 55 feet east and 3019 feet north of the intersection of the centerlines of North Milwaukee Avenue and Erskine Street; thence south along a line 55 feet east of the centerline of North Milwaukee Avenue to a point 55 feet east and 2614 feet north of the intersection of the centerlines of North Milwaukee Avenue and Erskine Street; thence west along a line 2614 feet north of the centerline of Erskine Street to a point 2614 feet north of the intersection of the centerl i nes of North Milwaukee Avenue and Erskine Street; thence south along the centerline 2 of North Milwaukee Avenue to a point 660 feet north of the intersection of the centerlines of North Milwaukee Avenue and Erskine Street; thence west along a line 660 feet north of the centerline of Erskine Street to a point 660 feet north and 150 feet west of the intersection of the centerlines of North Milwaukee Avenue and Erskine Street; thence south along a line 150 feet west of the centerline of North Milwaukee Avenue to the point of beginning. The voting place shall be designated by election order. Voting Precinct No. 136. Beginning at a point 60 feet north and 150 feet east of the intersection of the centerlines of Avenue P and 98th Street; thence south along a line 150 feet east of the centerline of Avenue P to a point 660 feet south and 150 feet west of the intersection of the centerlines of Avenue P and 981h Street; thence west along a line 660 feet south of the centerline of 981h Street to its intersection with Avenue P thence south alan~ Avenue P to a point 1320 feet south of the intersection of the centerlines of 98 Street and Avenue P; thence west along a line 1320 feet south of the centerline of 981h Street to a point 55 feet west and 1320 feet south of the intersection of the centerlines of 981h Street and Avenue P; thence south along a line 55 feet west of the centerline of Avenue P to a point 2629 feet south and 55 feet west of the intersection of the centerlines of 98th Street and Avenue P; thence east along a line 2629 feet south of the centerline of 98th Street to a point 3020 feet east and 2629 feet south of the intersection of the centerlines of 98th Street and Avenue P; thence north along a line 3020 feet east of the centerline of Avenue P to a point 3020 feet east and 376 feet north of the intersection of the centerlines of 981h Street and Avenue P; thence west along a line 376 feet north of the centerline of 98th Street to a point 376 feet north and 1960 feet east of the intersection of the centerlines of 98th Street and Avenue P; thence south along a line 1960 feet east of the centerline of Avenue P to a point 60 feet north and 1960 feet east of the intersection of the centerlines of Avenue P and 98th Street; thence west along a line 60 feet north of the centerline of 98th Street to the point of beginning. The voting place shall be designated by election order. SECTION 2. THAT the descriptions of the voting locations for the following named precincts shall be amended to read as fo llows: Voting Precinct No. 53. The voting place shall be the Elks Lodge at 3409 Milwaukee A venue. Voting Precinct No. 76. The voting place shall be Terra Vista Middle School. Voting Precinct No. 113. The voting place shall be Centennial Elementary School. Voting Precinct No. 114. The voting place shall be Wayland Baptist University. Voting Precinct No. 119. The voting place shall be Roberts Elementary School. 3 SECTION 3. THAT subsection 8-4(b) of the Code of Ordinances of the City of Lubbock, Texas is hereby amended to read as follows: (b) The voting precincts set out in this section are hereby divided into six (6) City Council voting districts, with each district to contain the following named voting precincts: Voting District No. 1: Precinct Nos. 1, 2, 3, 4, 5, 8, 10, 17, 18, 114, 132. Voting District No.2: Precinct Nos. 6, 19, 20, 25, 26, 29, 40. Voting District No.3: Precinct Nos.14, 15, 16, 21, 22, 23, 24, 28, 49,118, 119. Voting District No. 4: Precinct Nos. 12, 30, 52, 54, 60, 67, 75, 1 09, 122, 123, 126, 127, 133, 136. Voting District No.5: Precinct Nos. 7, 27, 57, 62, 66, 78, 96, 104, 110, 111,112,115,116,124,125,128,129,134. Voting District No.6: Precinct Nos. 9, 13, 47, 50, 53, 58, 59, 63, 72, 76, 92,113,130,131,135. SECTION 5. THAT subsection 8-4( c) of the Code of ordinances of the City of Lubbock, Texas, is hereby amended to read as follows: (c) The voting districts, voting precincts and voting places set out in this section are hereby delineated on the map denominated "City of Lubbock Voting Precincts/Districts, effective September 1, 2007/0fficial Map." A copy of said map is attached and made a part of this section as if fully copied herein in detail. A copy of the original of such map shall be kept in the office of the City Secretary and shall be available for public inspection, and at each special and general city election, a true copy of said map shall be furnished by the City Secretary to each of the presiding judges of the voting precincts for such special or general city election. SECTION 6. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 7. THAT all portions of Chapter 8 not expressly amended by this Ordinance shall remain as they are. SECTION 8. THAT the City Secretary is hereby authorized and directed to cause publication of this Ordinance in its entirety following final passage by the City Council. SECTION 9.
