AN ORDINANCE ABANDONING AND CLOSING FIVE 5-FOOT
DERGROUND UTILITY EASEMENTS FOR LP&L LOCATED IN LOTS 96, 125,
130, 134, 137, SOUTH BROOK ADDITION TO THE CITY OF LUBBOCK,
UBBOCK COUNTY, TEXAS, WHICH IS MORE PARTICULARLY DESCRIBED
THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO
THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID
BANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND
ROVIDING FOR PUBLICATION.
WHEREAS, the City Council finds the easements hereinafter described in the
ody of this Ordinance are no longer needed for easement purposes and for public use;
d it would be in the public interest to close, vacate and abandon the same for easement
urposes and for public use, and it would be in the public interest to close, vacate and
bandon the same; NOW THEREFORE:
E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the easement portions as hereinafter described shall BE and
e same is hereby closed, vacated and abandoned for easement purposes and for public
use, such easements being more particularly described as follows:
The 5-foot underground utility easement for LP&L along the east side of Lot 96,
South Brook Addition to the City of Lubbock, Lubbock County, Texas, according
to the map, plat and/or dedication deed thereof recorded in File No. 2007004679,
Real Property Records of Lubbock County, Texas. Save and except the
transformer pad easement in the northeast comer of Lot 96.
The 5-foot underground utility easements for LP&L along the north side of Lots
125, 130, 134, 137, South Brook Addition to the City of Lubbock, Lubbock
County, Texas, according to the map, plat and/or dedication deed thereof recorded
in File No. 2007004679, Real Property Records of Lubbock County, Texas. Save
and except the transformer pad easements in the northwest comer of Lots 130,
137 and the 20-foot underground utility easement on the west side of Lot 137.
SECTION 2. THAT the City Engineer is hereby authorized and directed to mark
the official maps of the City of Lubbock to reflect said abandonment and closing,
showing the number ofthis Ordinance and the date of its final passage.
SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or
word of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary of the City of Lubbock is hereby
uthorized and directed to cause publication of the descriptive caption of this Ordinance
san alternative method provided by law.
