HomeMy WebLinkAboutOrdinance - 2007-O0072 - Abandoning/Closing Underground Utllity/Transformer Pad Easement Located Lot 3B - 07/12/2007First Reading July 12. 2007 Item No. 5.23 ORDINANCE NO. 2007~0012 Second Reading July 26, 2007 Itea No. 5.3 AN ORDINANCE ABANDONING AND CLOSING AN UNDERGROUND UTILITY AND TRANSFORMER PAD EASEMENT LOCATED IN LOT 3B, ALL SAINTS ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS AND MORE PARTICULARLY DESCRJBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SA VJNGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the easement as hereinafter described in the body of this Ordinance is no longer needed for easement purposes and for public use; and it would be in the public interest to close, vacate and abandon the same for easement purposes and for public use, and it would be in the public interest to close, vacate and abandon the same; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the easement as hereinafter described shall BE and the same is hereby closed, vacated and abandoned for easement purposes and for public use, such easement being more particularly described as follows: BEGINNING at a point which is 1,417.00 feet south and 305 feet east of the northwest comer of Section 19, Block E-2; THENCE south a distance of 5 feet; THENCE east a distance of 40 feet; THENCE south a distance of 125 feet; THENCE east a distance of 5 fee~; THENCE north a distance of 130 feet; THENCE west a distance of 45 feet to the POINT OF BEGINNING. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. ,.
