AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE
OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING
CHANGES: ZONE CASE NO. 515-E; AlvfEND THE CONDITIONS OF
ORDINANCE 9827 ON C-4 ZONED TRACT 3 OF LOT 24, MURRYHILL
ADDITION, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING A
PENALTY; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR
PUBLICATION.
WHEREAS, the proposed changes in zoning as hereinafter made have been duly
presented to the Planning and Zoning Commission for its recommendation which was
received by the City Council and, after due consideration, the City Council found that due
to changed conditions, it would be expedient and in the interest of the public health,
safety and general welfare to make those proposed changes in zoning; and
WHEREAS, all conditions precedent required by law for a valid amendment to
the Zoning Ordinance and Map have been fully complied with, including giving notices
in compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas,
and the notices provided by the Texas Local Government Code §211.007 (Vernon, 1990),
and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15)
days prior to the date of the public hearing before the City Council on such proposed
amendment, and the public hearing according to said notice, was held in the City Council
Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in
support of the proposal; and after said hearing, it was by the City Council determined that
it would be in the public interest, due to changed conditions, that the Zoning Ordinance
and the Zoning Map be amended in the manner hereinafter set forth in the body of this
Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW
THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
ZONE CASE NO. 515-E
SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map are
amended as follows:
A change of zoning under the provisions of Section 29-29 of the Code of
Ordinances of the City of Lubbock from amending Ordinance 9827 by replacing
the conditions with the following conditions in the C-4 zoning district on Tract
3 of Lot 24, Murryhill Additiont City of Lubbockt Lubbock County, Texas,
located at 3664 50th Street and being subject to conditions.
SUBJECT TO THE FOLLOWING CONDITIONS:
1. THAT the use of the parcel for trailer rental as assigned in Ordinance
9827 is rescinded.
2. THAT one "for rene RV may be parked on the Memphis side of the
business. It will be parked as close to the building as practical. The "rent
me" or "for rent" sign in the window of the vehicle does not constitute a
"code" sign so long as it is in one of the windows of the RV.
3. THAT any additional RV units for rent shall be stored in the back of the
building, behind the building line (58 feet) on the Memphis side.
4. THAT an amended site plan is included in file Zone Case 515-E.
5. THAT the amended zoning shall continue the existing C-3 pennitted uses.
6. THAT the applicant shall propose a landscape plan for consideration and
approval by the Staff prior to becoming effective.
7. THAT the existing storage building on the east side of the business shall
be removed.
SECTION 2. THAT violation of any provision of this Ordinance shall be deemed
a misdemeanor punishable by fine not to exceed Two Thousand and Noll 00 Dollars
($2,000.00) as provided in Section 29-31 of the Zoning Ordinance of the City of
Lubbock.
SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of
this Ordinance be declared unconstitutional or invalid for any reason, the remainder of
this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary is hereby authorized to cause publication
of the descriptive caption of this Ordinance as an alternative method provided by law.
AND IT IS SO ORDERED.

Re: Zone Case No. 515-E (3664 50th Street): Request of Kathy Rodriguez (for Presto
Hail Lifters) for a zoning change from C-4 to C-4 with amended conditions to
ordinance 9827 to allow rental of recreational vehicles on Tract 3 of Lot 204
Murryhill Addition (the south 150 feet of the west 150 feet of Lot 204 Murryhill
Addition).
Distinguished Board Members~
As per our zoning case and the recommendation of the Lubbock City Council Zoning and
Planning Board~ I am presenting the folio~ ... ~' ing proposal for your consideration. The

would be located at the front of the property and would add visual appeal to an area
comprised mostly of concrete and asphalt. I would propose to plant an evergreen shrub to
either side of the planter box to give visual interest and consistency to the overall plan.
3. The last proposal is the addition of evergreen shrubs to both the west side (just north of
the flower bed) and the southeast comer of the property. The shrubs on the west side of
the property will replace concrete slabs that are currently in place to deter automobiles
from cutting the comer. I feel the shrubs will also deter drivers from cutting the comer
but in a more aesthetically pleasing manner. The shrubs on the east side of the property
will replace metal poles that are currently in place and add more of a visual distinction
between my business and the business to the east.
I would like to thank each of the Board Members for their time and consideration in this matter. I
feel this is a win-win situation for my business and the City of Lubbock.
