HomeMy WebLinkAboutOrdinance - 2006-O0111 - Abandoning/Cloisng Portion Of Two 20 Foot Alleys Located In Block 117 - 10/26/2006First: Reading October 26. 2006 Ite:aa No. 5.4 File and Return to Dave Booher R.O.W City of Lubbock Second Reading November 20. 2008 Item No. 5.8 ORDINANCE NO. 2006-oOlll AN ORDINANCE ABANDONING AND CLOSlNG A PORTION OF TWO 20- FOOT ALLEYS LOCATED IN BLOCK 117, ORIGINAL TOWN OF LUBBOCK, LUBBOCK COUNTY, TEXAS AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSlNG; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the two alley portions as hereinafter described in the body of this Ordinance is no longer needed for alley purposes and for public use; and it would be in the public interest to close, vacate and abandon the same for alley purposes and for public use, and it would be in the public interest to close, vacate and abandon the same; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the two alley portions as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for alley purposes and for public use, such alley portion being more particularly described as follows: All of the east portion of the East-West 20-foot alley from the west lot line of Lot 20 and Lot 11 to the west right-of-way line of Avenue Kin Block 117, Original Town of Lubbock, Lubbock County, Texas. All of the south portion of the North-South 20-foot alley from the north lot line of Lot 10 and Lot 11 to the north right-of-way line of Broadway in Block 117, Original Town of Lubbock, Lubbock County, Texas. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
