' ,, :, t FOS:lb ORDINANCE NO. ;;,,;:,« AN ORDINANCE AMENDING CHAPTER 2 OF THE CODE OF ORDI- NANCES OF THE CITY OF LUBBOCK, TEXAS, BY ADDING THERETO A NEW ARTICLE X PROVIDING FOR LUBBOCK PUBLIC TRANSIT ADVISORY BOARD; PROVIDING FOR APPOINTMENT OF MEMBERS AND TERM OF OFFICE; PROHIBITING CREATION OF ANY INDEBTEDNESS; PROVIDING FOR SAVINGS CLAUSE AND FOR PUBLICATION OF CAPTION. WHEREAS, the City Council has determined that it is in the public interest that a public transit system be operative within the City of Lubbock, and WHEREAS, arrangements have been made to secure the necessary equipment to provide such transit system. and WHEREAS, the City Council deems it expedient and to the advantage of the inhabitants of the City of Lubbock that the Council be provided with ad- vice, from time to time in regard to promotion, routes, expansion, operation- al policies and rates as well as other areas which may be necessary or de- sireable to operate, maintain, preserve and promote an orderly and business like administration of the public transit system for the City of Lubbock; NOW THEREFORE: BE IT ORDAIN'ED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Chapter 2 of the Code of Ordinances of the City of Lubbock, Texas BE and is hereby amended by adding thereto a new ARTICLE X, which shall hereafter read as follows: 11ARTICLE X-LUBBOCK PUBLIC TRANSIT ADVISORY BOARD "Section 2-86. Created; Composition; Terms of Members. 11There is h ereby created and established a board to be known and designated as the 11Lubbock Public Transit Advisory Board'' consisting of five members who .shall be appointed by the City Council and the City Manager, or his designated representative, as ex-officio member to said Board. The present Transit Advisory Committee as now constituted by Resolution adopted May 23, 1974, shall be and are h ereby appointed to serve as the Lubbock Public Transit Authority. The tenure of the members of said Board shall be determined as hereafter provided [FOS~lb at the first organizational meeting which shall be called by the present Chairman of the Transit Advisory Committee, at which time the members by lot, to determine the tenure of two members to serve for two years and one member to serve for three years from date of said meeting or until their successors are appointed by the City Council who will serve a full three year term. The Board shall adopt its own rules of procedure and elect its Chairman and Vice-Chairman who shall serve for a term of one year. 11Section 2-87. Responsibility of the Board. 11The Lubbock Public Transit Advisory Board shall be responsible to the City Council in the areas of promotion, routes, expansion,. operational poli- cies and rates as well as other areas which in its opinion may be necessary or desireable to operate, maintain,. preserve and promote an orderly, econo- mic and businesslike administration of the public transit system of the City of Lubbock and make recommendations thereon to the City Council from time to time. 11Section 2-88. Shall Create No Indebtedness. 11No debt shall be contracted by the Board nor any member thereof on behalf of the City of Lubbock unless the same is directed by the City Council. 11 SECTION 2. THAT should any section, paragraph, sentence, clause phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 3. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method of publication provided by law, whereupon after publication this Ordinance shall become effective.
