HomeMy WebLinkAboutOrdinance - 2006-O0087 - Amending Chapt. 28 With Regard To Water And/Sewer Improvements - 08/10/2006Jirst Reading August 10~ 2006 Item Bo. 6.4 ORDINANCE NO. 2006-00087 Second Reading August 24, 2006 Item Bo. 5.2 AN ORDINANCE AMENDING CHAPTER 28 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO ACCEPTANCE OF WATER AND/OR SEWER IMPROVEMENTS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, it is the opinion of the City Council of the City of Lubbock that the best interests of the citizens of the City of Lubbock would be served by amending Chapter 28 of the Code of Ordinances of the City of Lubbock; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1: THAT Section 28-156 of the Code of Ordinances, City of Lubbock, Texas, is hereby amended to read as follows: Sec. 28-156. Facilities to be property of city. Upon completion of the water and/or sewer facilities in accordance with the design approved by the city by private contractor and acceptance by the city, as set forth herein, or upon completion by the city, the facilities so constructed shall become and remain the property of the city and shall be maintained as a part of its water ::i.nd/or sewer system. After final inspection and approval of the water and/or sewer improvements required by Chapter 25 of this Code, the City Manager or his or her designee shall accept the said improvements, except where city costs are related to the said acceptance in which case the Water Utility Chief Engineer, or his or her designee shall submit the said improvements to the City Council for their consideration for approval and acceptance. SECTION 2. THAT violation of any provision of this Ordinance shall be deemed a misdemeanor punishable as provided by Sec. 1-4 of the Code of Ordinances of the City of Lubbock, Texas. SECTION 3. THAT should any paragraph, section, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method of publication by law.
