HomeMy WebLinkAboutOrdinance - 7253-1976 - Altering The Prima Facie Speed Limits On Certain Portions Of 58Th St. - 05/13/1976_i ,· . , I r JWF/gm ORDINANCE NO. 7253 AN ORDINANCE ALTERffiG THE PRIMA FACIE SPEED LilVJITS ON CERTAIN PORTIONS OF 58TH STREET, AS HEREINAFTER MORE PAR- TICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING PLACE1\t1ENT OF SIGNS WITH RESPECT THERETO; REPEALING CON- FLICTING ORDINANCES TO THE EXTENT OF SUCH CONFLICT; APP.LI- CATION OF TI:ITS ORDINANCE ONLY TO STREETS OR IDGHWAYS NAMED HEREIN; PROVIDING TlilS ORDINANCE SHALL BE CUMULATIVE; PRO- VIDING A SAVINGS CLAUSE AND FOR PUBLICATION HEREOF, AND A PENALTY CLAUSE. WHEREAS, the governing body of the City of Lubbock, upon the basis of an engineering and traffic investigation finds it necessary to alter prima faci.e speed limits established by Article 6701d, Section 166 (a)l, Vernonts Texas Civil Statutes as amended Acts 1971, 62nd Legislature, page 708, Chapter 73, within the area and at the location named and designa- ted in the body of this Ordinance, all within the corporate limits of the City of Lubbock: NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT prima facie speed limits on the following streets and highways i.n the urban district set forth below i.s hereby altered and changed as hereinafter set forth upon the following described portions of streets and/ or hi.ghways located within the City of Lubbock, Lubbock County, Texas, to-wit: SCHOOL ZONE A 20 MPH Speed Zone, when the school signal is flashing on both sides of 58th Street beginning at a point 175 feet West of the Centerline of Elgin Avenue and extending East for a di.stance of 1, 245 feet. SECTION 2. THAT all Ordinances or parts of Ordinances con- flicting wi.th any of the provisions hereof are hereby repealed insofar as such conflict exists. SECTION 3. THAT all highways or streets not specifically set forth in the preceeding sections hereof shall not be affected by the provisions hereof, and this Ordinance shall be cumulative of all other prima facie speed limit Ordinances except those with which it specifically conflicts. THE City Manager is hereby authorized and directed to cause the placing and maintenance of such traffic control signals and/or devices and/or signs as shall be necessary to apprise the public of the 20 M. P~ H. zones as hereinabove set forth. SECTION 5. THAT should any Section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 6. THAT any person, firm or corporation violating the prima facie speed limit established by this Ordinance shall, upon conviction be fined any sum not to exceed TWO HUNDRED (200. 00) DOLLARS. SECTION 7. THAT the City Secretary is authorized and directed to cause the publication of the descriptive caption of this Ordinance together with the penalty provision as an alternative method of publication as provided by law. AND IT IS SO ORDERED.
