HomeMy WebLinkAboutOrdinance - 2006-O0033 - Abandoning/Closing Poriton Of Frankford Avenue - 03/23/2006First Reading March 23, 2006 Item No. 5.8 File And Retutn To Ed Bucy R-0-W ORDINANCE NO. 2006-oD033 Second Reading April 26, 2006 Item No. 5.2 AN ORDINANCE ABANDONING AND CLOSING A PORTION OF FRANKFORD AVENUE LOCATED IN SECTION 5, BLOCK E-2, LUBBOCK COUNTY, TEXAS, WHICH IS MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that portion of the street hereinafter described in the body of this Ordinance are no longer needed for street purposes and for public use; and I WHEREAS, the City CoWlcil finds it would be in the public interest to close, vacate and abandon the same for street purposes and for public use; NOW II THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the street portion as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for street purposes and for public use, such street is more particularly described as follows: METES AND BOUNDS DESCRIPTION for a 0.3597 acre portion of Frankford Avenue to be closed and abandoned located in Section 5, Block E-2, Lubbock CoWlty, Texas, being further described as follows: BEGINNING at a point in the West line of Section 5, Block E-2, Lubbock County, Texas, which bears South a distance of207.58 from the Northwest corner of the Southwest Quarter of Section 5, Block E-2, Lubbock CoWlty, Texas; THENCE S. 60°00'00" E. a distance of 46.19 feet to a point in the East right-of- way line of Frankford A venue and the West line of that tract of land described in Volume 6270, Page 154, Real Property Records of Lubbock CoWlty, Texas; THENCE South, along the East right-of-way line of Frankford Avenue and the West line of said tract of land described in Volume 6270, Page 154, a distance of 219.39 feet to a point; THENCE N. 60°00'00" W. a distance of92.38 feet to a point in the West right-of- way line ofFrankford Avenue to a point; THENCE North, continuing along the West right-of-way line of Frankford Avenue, a distance of 125.20 feet to a point; THENCE N. 30°00'00" E. a distance of 54.88 feet to a point of curvature; THENCE Northwesterly, around a curve to the left, said curve having a radius of 392.29 feet, a central angle of 3°54'03", tangent lengths of 13.36 feet, a chord distance of 26.70 feet, and a chord bearing ofN. 28°02'58"42" E. to the POINT OF BEGINNING. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandorunent and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. They will probably VOID the ordinance and start over). thanks Page 1 ~ Agt~tdtl Jmre 11.1111 Ordinance lst Reading -Right-of-Way: Consider an ordinance abandoning and closing a portion of Frankford Avenue located in SectionS, Block E-2, Lubbock County, property located at 2605 Frankford Avenue. Ium Sri""""'Y Lubbock Christian University is in the process of building a golf course on their property east of Frankford Avenue and north of 34th Street. As part of the conatruction, they are platting a one acre tract of land on which to construct a golf clubhouse building. A portion of this platted tract, 0.3597 acres, WiR be located in the "old" right-of-way of Frankford Avenue. In 1984, Frankford Avenue was rear~gned and widened to the west of this old portion of Frankford Avenue that is being closed. As it now exists, this portion of Frankford Avenue is just a dirt street that L.C.U. uses to access their property. Part of lubbock Christian University's long range plan is to close all of this "old" portion of Frankford Avenue. Since LC.U. was not the original dedicator of the street area being closed, there wm be a charge for this 0.3597 acres (15,668.5 sq. ft.). From adjacent property values and a review of existing sale& comparable$, a value of $00.23 per sq. ft. is determined for an appraised value of $3,603.76. The area being closed will remain as a utility easement so a 50% adjustment will be applied to this $3,603.76 for a $1,801.88 charge to l.C.U. The City presently leases a tract of land from l.C.U. at 20th and Elmwood Avenue for a recyde oenter. Our yearly rent the City pays to L.C.U. fur this tract of land ia $1,800. LC.U. is in agreement to waive the next year's fee in exchange for this closure cost Flsctlllmpact No fiacal impact to the City.
