AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF
THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 1490-E;
TO AMEND THE SITE PLAN OF LOT 1-A AND 2-A, FIESTA AUTOLAND CENTER ADDITION TO
TIIE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS; SUBJECT TO CONDITIONS; PROVIDING
FOR A PENALTY AS PROVIDED FOR IN SECTION 1-5 OF THE CITY CODE; PROVIDING A
SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, the City Council of the City of Lubbock has hereto for approved
zoning on this tract subject to a site plan pursuant to Ordinance No. 6119 and
7233; and
WHEREAS, there is now a request of the City Council of the City of Lubbock
to amend said site plan; and
WHEREAS, the City Council of the City of Lubbock finds that the site plan
should be amended as hereinafter set out; and
WHEREAS, the proposed changes in zoning as hereinafter made have been duly
presented to the Planning and Zoning Commission for its recommendation which
was received by the City Council and, after due consideration, the City Council
finds that due to changed conditions, it would be expedient and in the interest
of the public health, morals, and general welfare to make those proposed changes
in zoning; and
WHEREAS, all conditions precedent required by law for a valid amendment to
the Zoning Ordinance and Map have been fully complied with, as well as giving
notices in compliance with Section 26 of Ordinance No. 7084, as well as notices
provided by Article lOllf, Vernon1 s Annotated Civil Statutes, amended in 1961,
and notice was duly published in the Lubbock Morning Avalanche-Journal more
than fifteen (15) days prior to the date of the public hearing before the City
Council on such proposed amendment, and the public hearing according to said
notice was duly held in the City Council Room on the second floor of the City
Hall, Lubbock, Texas, at which time persons appeared in support of the proposal;
and, after said hearing, it was by the City Council determined that it would be
in the public interest, due to changed conditions, that the Zoning Ordinance
and the Zoning Map be amended in the manner hereinafter set forth in the body
of this Ordinance and this Ordinance having been introduced prior to first
reading hereof; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
ZONE CASE NO. 1490-E
SECTION 1, THAT Ordinance No, 7084 and the Official Zoning Map BE and
the same are hereby amended as follows, to-wit:
To amend the site plan Lot 1-A and 2-A, Fiesta Autoland Center Addition to
the City of Lubbock, Lubbock County, Texas located at Loop 289 and Slide
Road, as follows:
a. Fence may be removed only to a point even with the North right of way
line of 68th Street. The remaining fence shall be maintained as a
screening fence to screen commerical activities on the property from
adjoining properties.
b. That landscaping consisting of trees planted on 15 1 -181 centers and
ground cover be installed in accordance with the site plan.
c. Sidewalk shall be installed in accordance with site plan.
d. Fence shall be repaired with original colored brick or entire fence
painted.
e. That a fence be installed across the back portion of the developed
lot.
f, Six foot sidewalk instead of five foot.
g. Trees are to be planted 18' on center.
h, Trees can be planted from the .fence to a maximum distance of 3.5'
away from the fence without any limitation with regard to caliber of
tree trunk.
i, Irrigation system be installed in the right of way with bubble heads
(or drip system) except at the two dirve approaches where spray heads
may be used, designed so as to not spray onto the st'reet pavement
surface.
j. All other provisions as tied to the site plan presented to the City
Council,
SECTION 2. THAT if all the conditions set out in Section 1 above are
not completed within eight months of the effective date of this Ordinance, this
amendment will lapse and the property will be subject to the conditions in the
site plan as approved in Ordinance No. 7233.
SECTION 3. THAT violation of any provisions of this Ordinance shall be
deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as
provided in Section 1-5 of the City Code.
SECTION 4. THAT should any paragraph, sentence, clause, phrase or word
of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.
SECTION 5. ·THAT the City Secretary is hereby authorized to cause
publication of the descriptive caption of this Ordinance as an alternative
method provided by law.

of Existing Brick Fence and Landscaping Requirement
1. Lowering of the existing six foot fence to approximately
two foot in height and landscapi_ng-of the area between the
two foot fence and Slide Road will greatly enhance the
appearance of the neighborhood. This will be a benefit to
not only area lando~ners but to everyone in the city who has
occasion to travel Slide Road south of Loop 289.
2. Traffic safety would be enhanced by increasing visibility
to-driver-s ex•iting the South Plains Chevrolet parking. lot
on to Slide Road.
3. Lowering of the fence would increase the development
possiblities for the vacant lots north of 69th Street and
south of South Plains Chevrolet.
4 •.. The requested action would eliminate. the current weed --
and trash problem along Slide Road.

Please file this letter in the above referenced zone case as
evidence of my approval of the requested change. It is my
understanding that the six foot fence along Slide Road is to
be removed and the area between the fence and Slide Road
landscaped. I believe this action would improve the looks
of the neighborhood and I find no objection to it.
