ORDINANCE NO. 7233
AN ORDINANCE AMENDING ZONING ORDINANCES NO. 5307 AND
6119 OF THE CITY OF LUBBOCK COVERING ZONE CASE NO. 1490-C,
BY REPEALING THE CONDITIONS MADE A PART OF SUCH ORDINANCES
AND ENACTING NEW CONDITIONS COVERING THE SUBJECT PROPERTY;
PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY CLAUSE AND
PROVIDING FOR PUBLICATION.
'WHEREAS, the City Council finds that after all notices have been
given and hearings held as provided by law, that i.t is in the best interest
of the citizens of the City of Lubbock to make the change in the zoning law
as hereinafter set forth; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Zoning Ordinances No. 5307 and 6119 of the Clty
of Lubbock BE and are hereby amended by repeali.ng the conditions made
a part thereof and enacting new conditions which shall read as follows:
1. That 1-00 .foot building setback lines be observed
from the property -lines along Loop 289.
2. That 43 foot building setback lines be observed
along Slide Road and Utica Avenue.
3. That a six foot solid permanent type screening
fence be erected and permanently maintained along
the West property lines. The fence along the West
property line shall be of brick construction. Addi-
tional vehicular traffic shall be permitted through
the West fence wherever a street be dedicated by
the owners and approved by the Planning and Zoning
Com·mission.
4. That a 14. 91 foot setback from the rear property
line shall be observed.
SECTION 2. THAT should any section, paragraph, sentence, clause,
phrase or word of this Ordinance be declared unconstitutional or invalid for
any reason, the remainder of this Ordinance shall not be affected thereby.
SECTION 3. THAT any person, firm or corporation owning or
operating the subject property failing to comply with the conditions imposed
by Section 1 hereof shall be guilty of a misdemeanor and upon conviction
thereof, shall be subject to a fine not to exceed TWO HUNDRED DOLLARS

and each and every day1 s violation thereof shall constitute a separate and
distinct offense.
The failure of any corporation owning or operating the subject prop-
erty to comply with any of the conditions imposed by Section 1 hereof shall
render the President, Vice-President, General Manager, Local Manager,
and Local Agent liable to the penalty prescribed in this section.
SECTION 4. THAT the City Secretary is hereby authorized to cause
publication of the descriptive caption of this Ordinance as an alternative
method provided by law.
