AN ORDINANCE AMENDING SECTIONS 25-6(B)(4) OF THE CODE
OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, BY THE
ADDITION OF REGULATIONS GOVERNING THE INSTALLATION OF
STREET LIGHTS IN NEW SUBDIVISIONS; REQUIRING PAYMENT OF
FEES RELATED TO SUCH INSTALLATION; PROVIDING A SAVINGS
CLAUSE; AND PROVIDING FOR PUBLICATION.
WHEREAS, THE City Council of the City of Lubbock deems it to be in the
best interest of the citizens of the City of Lubbock to establish cost recovery fees for
the installation of street lights; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Section 25-6(b )( 4) of the Code of Ordinances, City of
Lubbock, Texas, is hereby amended to read as follows:
Section 25-6(b)(4). Street lighting.
1. Street lights shall be placed at all street intersections and other locations within
and abutting the subdivision with the exception of thoroughfare lighting. Street lights
shall be placed for both location and nwnber in accordance with the current city
standards; Engineering design and installation as well as actual inspection of the
street light construction shall be performed by Lubbock Power and Light. The
developer shall inform Lubbock Power and Light of the style of standard and light
fixture to be installed, each of which shall be approved by Lubbock Power and Light.
If the development chooses a non-standard fixture, the developer shall provide design
and specifications, receive approval of specifications, and perform the review process
as well as the placement and number of fixtures referenced above.
A cost recovery fee for design of materials, installation and specifications and the
inspection of construction is established at $70 per standard/fixture, a cost that may
be subsequently revised pursuant to Lubbock City Code, Section 1-10.
The developer may choose for Lubbock Power and Light to use the standards
traditionally used within subdivisions and will make those construction arrangements
with Lubbock Power and Light, exclusive of the requisite fees noted above. The cost
per traditional standard/fixture is established at $2,500.
A developer may choose Lubbock Power and Light as the contractor for non-
traditional street lighting and shall negotiate a price for materials and labor. The
inspection fee for design of materials, installation and specifications, and the
inspection of construction will be in effect regardless whether Lubbock Power and
Light is the contractor.
2. Any appeal of a decision of Lubbock Power and Light shall be to the Planning
Commission of the City of Lubbock. Any appeal of a decision of the Planning
Commission shall be to the City Council. The decision of the City Council shall be
final.
SECTION 2. This ordinance shall only govern applications for plats recorded
after July 31,2006.
SECTION 3. THAT should any paragraph, section, sentence, phrase, clause
or word of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary is hereby authorized and directed to
cause publication of the descriptive caption of this Ordinance as an alternative
method of publication as provided by law.
