HomeMy WebLinkAboutOrdinance - 2006-O0015 - Ordinance Nominating An Area As Defense Economic Readjustment Zone - 01/26/2006First Reading January 26, 2006 Item No. No. 6.10 Sec--;,nd "Reading February 9, 2006 Item No. 5.3 ORDINANCE Ho~-2006-QOOlS AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LUBBOCK, TEXAS NOMINATING AN AREA AS A DEFENSE ECONOMIC READJUSTMENT ZONE PURSUANT TO THE TEXAS DEFENSE ECONOMIC READJUSTMENT ZONE ACT (TEXAS GOVERNMENT CODE, CHAPTER 231 0); DESIGNATING AN AUTHORIZED REPRESENTATIVE TO ACT IN ALL MATTERS PERTAINING TO THE NOMINATION AND DESIGNATION OF THE AREA DESCRIBED HEREIN AS A DEFENSE ECONOMIC READJUSTMENT ZONE AND REINVESTMENT ZONE (TEXAS TAX CODE, CHAPTER 312); AND FURTHER DESIGNATING A LIAISON TO ACT ON ALL MATTERS PERTAINING TO THE DEFENSE ECONOMIC READJUSTMENT ZONE ACT ONCE DESIGNATED BY THE TEXAS ECONOMIC DEVELOPMENT BANK. WHEREAS, the City Council of the City of Lubbock, Texas desires to create the proper economic and social environment to induce the investment of private resources in productive business enterprises located at Reese Air Force Base, closed on September 30, 1997, and to provide employment to residents of the area; WHEREAS, certain conditions exist in such area which represent a threat to the health, safety, and welfare of the people of such area; and WHEREAS, it is necessary and in the best interest of the City to nominate such area as a defense economic readjustment zone pursuant to the Texas Defense Economic Readjustment Zone Act (Texas Government Code, Chapter 2310, the "Act"); NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK, TEXAS: Section 1. THAT the City of Lubbock hereby nominates the area indicated on the maps attached hereto as Exhibit A and further described in Exhibit B as a defense economic readjustment zone in accordance with the Act: That the City Council finds the zone area meets the qualifications of the Act. That certain local incentives applicable to business enterprises in the zone which are not applicable throughout the City as indicated on Exhibit C may be provided. Section 4. Section 5. Section 6. Section 7. Section 8. That the area described in this ordinance is designated as a defense readjustment zone, and a reinvestment zone, subject to the approval of the Texas Economic Development Bank. That the City Council directs and designates its mayor as the City's authorized representative to act in all matters pertaining to the nomination and designation of the area described herein as a defense readjustment zone and a reinvestment zone. That the City Council further directs and designates the Executive Director of the Reese Redevelopment Authority as liaison for communication with the Bank to oversee zone activities and communications with qualified businesses. That a public hearing to consider this ordinance was held by the City Council on January 26, 2006. That this ordinance shall take effect from and after its passage as the law and charter provide. WHEREAS, COUNTY is a political subdivision of the State of Texas operating under the general laws of the State of Texas; and CITY is a home rule municipal corporation operating under the charter of the municipality; and WHEREAS, COUNTY and CITY mutually desire to encourage the Lubbock Reese Redevelopment Authority to promote and redevelop the property known as Reese Technology Center; THEREFORE, the following agreement is entered by and between COUNTY and CITY as follows: CITY and COUNTY shall jointly administer the Reese Technology Center Defense Economic Readjustment Zone. CITY shall provide personnel and administrative services associated with filing, monitoring, auditing, and all other responsibilities required for Tax Abatement in the Zone. Any payments for services that arise or may arise out of the performance of this Agreement shall be made from the current revenues available to the paying party. Either party may terminate this agreement upon written notice to the other. IN WITNESS WHEREOF, the parties to this Agreement have executed this Agreement as of the effective date written below, each respective party acting by and through its governing body or its designee in the manner required by each party's charter or otherwise required by law on the date herein below specified. This fee will be in the amount of the fee originally paid by the business to the City and/or County for platting property within the designated Defense Readjustment Zone. This refund would be made upon the business' attainment of the job requirement, and submittal of an application and necessary documentation within a three-year period of the business' start of operation in the Defense Economic Readjustment Zone . Fair Market Rental Value Fair Market Rental Values are discounted rents used by Lubbock Reese Redevelopment Authority (LRRA) based on the job creation potential of a lease, including the number and quality of jobs that will be created. County Property Tax Abatement County Ad Valorem taxes on improvements, by new construction or modernization of industrial projects will be eligible to be abated for a period of ten (10) years up to 100% per year. Abatement will be considered if the individual project meets criteria and guidelines, established for this use by the affected jurisdiction.
