HomeMy WebLinkAboutOrdinance - 2005-O0114 - Amending Chapt. 28, Sect. 28-86, Revising Sewer Service Rates - 09/21/2005Fint Reading September 21, 2005 Item42 Second Reading October 13, 2005 Item No. 4.6 ORDINANCE NO. -=2=00=5:....::.Q:.=O..:.ll:.:4::....._, __ _ AN ORDINANCE AMENDING CHAPTER 28 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, BY AMENDING SECTIONS 28-86, SUBSECTIONS 28-86(a) AND 28-86(b) OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK BY REVISING SEWER RATES AS CONTAINED THEREIN: PROVIDING A SAVING CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council of the City of Lubbock deems it to be in the best interest of the citizens of the City of Lubbock to adjust sewer rates within the City of Lubbock to reflect the cost of service; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK; SECTION 1: THAT Section 28-86, subsections 28-86(a) and 28-86(b) of the Code of Ordinances, City of Lubbock, Texas, is hereby amended to read as follows: Section 28-86. Rates charged for sewer service. (a) The basic monthly rates for sewer service which shall be charged to all customers shalt be as follows: Size Rate .75" $3.94 1" & 1.25" $9.20 1 Yz" $17.97 2" $28.49 3" $61.82 4" $175.81 6" $351.18 8" $438.88 10" $877.32 (b) In addition to the base rate, all customers shall pay the flow rate per one thousand (1,000) gallons, which shall be as follows: Flow Rate: $1.67 SECTION 2: THAT the City Council finds and declares that sufficient written notice of the date, hour, place and subject of this meeting of the Council was posted at a designated place convenient to the public at the City Hall for the time required by law preceding this meeting, that such place of posting was readily accessible at all times to the general public, and that all of the foregoing was done as required by law at all times during which this Ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents of posting thereof. SECTION 3: THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method of publication as provided by law. AND IT IS SO ORDERED.
