HomeMy WebLinkAboutOrdinance - 7152-1975 - Authorizing The Issuance Of A Single Use Permit: Zone Case #1999-A - 09/24/1975KJ:rm· ORDINANCE NO. -Zr....:l....:5=-2 __ AN ORDINANCE AUTHORIZING THE ISSUANCE OF A SPECIFIC USE PERMT, TO-WIT: ZONE CASE NO. 1999-A: CHANGE A TRACT OF LAND OUT OF SECTION 6, BLOCK E-2, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM A 11C-3'' TO A "C-4" SPECIFIC USE PERMIT; PROVIDING A CONDITION; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, after receiving the recommendations of the Planning and Zoning Commission and after due notice and public hearing and all matters having been done and performed as required by Section 22 of Zoning Ordi- nance No. 7084 of the City of Lubbock, (said Ordinance being an Appendix to the Lubbock City Code) relating to Specific Use Permits, the City Council finds that due to changed conditions, it would be expedi.ent and in the interest of the public health, morals, and general welfare to authorize the granting of a Specific Use Permit as hereinafter set forth; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the Director of Planning of the City of Lubbock is authorized to issue a Specific Use Permit to the Applicant in Zone Case No. 1999-A in accordance with the recommendations and conditions imposed by the Planning and Zoning Commission, on file with the office of the Director of Planning, and the City Council whi.ch al!e hereby adopted and incorporated herein by reference for all purposes, provided said Applicant agrees to be bound by the terms of the Specific Use Permit: the granting of which is hereby made subject to compliance to all provisions of Zoning Ordinance No. 7084, an Ordinance of the City of Lubbock, including particularly, but not limited to Section 22 of Zoning Ordinance No. 7084, within twenty-four (24) months of the effective date of thi.s Ordinance, the City Secretary-Treasurer shall be and is hereby authorized and instructed, upon written notice from the Director of Planning that Applicant has not complied with the provisions, conditions and terms imposed by this Ordinance, to note Applicant1s failure to comply on the margin of the Minutes of the City Council opposite entry of this Ordinance, and the authorization to issue such Specific Use Permit is hereby revoked; and the Director of Planning in such event is directed to remove from the Zoning Map the legend indicating such limited use. The Specific Use authorized by this Ordinance i.s permitted under provision of Section 22. 3-23 of the Zoning Ordinance on the property described below. ZONE CASE NO;, 1999-A Change a tract of land out of Section 6, Block E-2, City of Lubbock, Lubbock County, Texas, from a "C-3 11 to a 11C-4'1 Specific Use Permit. KJ:rmj PROPERTY IS FURTHER DESCRIBED BY METES AND BOUNDS, TO-WIT: BEGINNING at a point which is the Southwest corner of Lot 1-B .. Westmorland Addition and proceeding N 36 ° 351 2011 West along the property line dividing Lot 1-B and Lot 1-C a distance of 208. 21' to a point in the South R. O. W. line of the Brownfield Highway; THENCE N 46 ° 4F E along the South R. O. W. line a distance of 271. 26' to a point; THENCE S 30 ° 221 3611 West a distance of 232. 951 to a point in the North line of the alley; THENCE S 53 °39• W a distance of 245.141 to the point of begin- ning. SUBJECT TO THE FOLLOWING CONDITION: In the event the right-of-way which abuts the subject property is used~ the sign authorized hereby will be relocated in accordance with such right-of-way use. SECTION 2. THAT any person, firm or corporation owning or opera ting the subject property failing to comply with the conditions imposed by Section 1 hereof shall be guilty of a misdemeanor and upon conviction thereof shall be subject to a flne not to exceed TWO HUNDRED DOLLARS and each and every day's violation thereof shall constitute a separate and distinct offense. The failure of any corporation owning or operating the subject prope to comply with any of the conditions imposed by Section 1 hereof shall render the President, Vice-President, General Manager, Local Manager and Local Agent, liable to the penalty prescribed in this Section. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. I AND IT IS SO ORDERED.
