HomeMy WebLinkAboutOrdinance - 2005-O0099 - Amending Chapter 6, Sect. 6-81.5; Revising Fees For Building Inspection Permits - 08/25/2005First Reading August 25, 2005 Item 54 ORDINANCE NO. 2005-00099 AN ORDINANCE AMENDING CHAPTER 6 OF THE CODE OF Second Reading September 8, 200S Item9 I ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, BY AMENDING SECTIONS I 6-81.5; AND SUBSECTIONS 6-23(a); 6-103(1); AND 6-228(1) OF THE CODE OF I ORDINANCES OF THE CITY OF LUBBOCK BY REVISING FEES FOR BUILDING INSPECTION PERMITS AS CONTAINED THEREIN: PROVIDING A SAVING CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council of the City of Lubbock deems it to be in the best interest of the citizens of the City of Lubbock to adjust building inspection permit fees within the City of Lubbock to reflect the cost of service; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK; SECTION 1: THAT Subsection 6-23(a) (107.2) of the Code of Ordinances, City of Lubbock, Texas, is hereby amended to read as follows: I 07. 2. Building permit fees. (a) Building permits for new construction and additions to buildings shall be $0.10 per square foot with a $30 minimum fee. Every application for a building permit shall be accompanied by the payment therefor. Said fees may be adjusted hereafter by City Council action or in accordance with Sec. 1-10 of the Code of Ordinances. SECTION 2. THAT Section 6-81.5 (106.6.2) of the Code of Ordinances, City of Lubbock, Texas, is hereby amended to read as follows: 106.6.2. Fee schedule. New construction/additions to existing buildings shall be $0.05 per square foot with a $30.00 minimum. Alterations of existing buildings (per $1,000.00 valuation) shall be $2.00 with a $25.00 minimum. SECTION 3. THAT Subsection 6-103(1.) (106.5.2) of the Code of Ordinances, City of Lubbock, Texas, shall be amended to read as follows: 1. New construction/additions to buildings shall be $0.05 per square foot with a minimum fee of$30.00. SECTION 4. THAT Subsection 6-228(1) of the Code of Ordinances, City of Lubbock, Texas, shall be amended to read as follows: (1) In every instance where an electrician licensed by the board is securing a pennit issued pursuant to this Code is seeking to undertake electrical work in, on or about any new construction within the city, the pemrit fee to be charged shall be at the rate of five cents ($0.05) per square foot of said new construction as calculated from the plans by the building official. However, in every case a minimum fee of thirty dollars ($30.00) shall be charged for the permit. New construction for the pwposes of this section shall mean the erection of a new building or structure or the erection of an addition to an existing building or structure which proposed building, structure or addition has not had electrical current available to said proposed building, structure or addition. SECTION 5: THAT the City Council finds and declares that sufficient written notice of the date, hour, place and subject of this meeting of the Council was posted at a designated place convenient to the public at the City Hall for the time required by law preceding this meeting, that such place of posting was readily accessible at all times to the general public, and that all of the foregoing was done as required by law at all times during which this Ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents of posting thereof. SECTION 6: THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 7. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method of publication as provided by law. BACKGROUND/DISCUSSION: This is the first reading of the ordinance adopting and levying the tax rate for the City of Lubbock for FY 2005-06. The budget ordinance must be considered first, followed by the ordinance adopting the levying of a tax rate. The ordinance will be placed on the Thursday, September 8th City Council agenda for the second reading and adoption of the budget. A property tax rate decrease is proposed. A decrease of .0125 is proposed decreasing the property tax from 0.4597 to 0.4472 per $100 valuation. The tax rate is distributed as follows: Debt Service General Fund M&O Economic Development FISCAL IMP ACT: N/A SUMMARY/RECOMMENDATION: Staff recommends approval. $0.06094 $0.35626 $0.03000
