ORDINANCE NO. 7142 ------------------
AN ORDINANCE REPEALING ORDINANCE NO. 5765 OF THE CITY OF
LUBBOCK SO AS TO REMOVE A 20 M.P. H. SPEED (WHEN TRAFFIC CON-
TROL LIGHT IS FLASHING IN SCHOOL ZONE); DIRECTING REMOVAL OF
SIGNS AND/OR TRAFFIC CONTROL DEVICES WITH RESPECT THERETO;
PROVIDING 40 M.P.H. ZONE IN EFFECT AT ALL TIMES BECAUSE OF
SAID 20 M.P.H. ZONE REMOVAL; AND PROVIDING A PENALTY FOR
VIOLATION HEREOF AND FOR PUBLICATION.
WHEREAS~ by Ordinance No. 5765 duly passed on second reading on or
about October 23, 1969, the prima facie speed limit was altered by lowering
same to twenty (20) M.P. H. in a school zone with flashing traffic control
(when same is in operation); and,
WHEREAS, based upon traffic and engineering investigation and data, it
is hereby determined said 20 M.P.H. when traffic-control-is-flashing-schoo
zone as established by said Ordinance No. 5765 on 50th Street at a point 190
feet East of the Center of Utica Avenue (South Side) and extending West for
400 feet is not needed and it would be to the public interest, safety, and wel-
fare to remove said zone by the repeal of said Ordinance No. 5765 in its
entirety; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Ordinance No. 5765 is hereby repealed in its entiret
and shall be no longer of any force and effect.
SECTION 2. THAT removal of all signs and/or traffic control signals
placed pursuant to said Ordinance No. 5765 by the City Manager or his dele-
gatee is hereby authorized and directed.
SECTION 3. THAT the school zone area described in the preamble hereof
shall at all times now be a 40 M.P. H. Speed Zone for traffic (since this Ordi
nance removes the 20M. P.H. Zone when traffic control device is flashing).
SECTION 4. Any person, firm, or corporation violating the provisions
of this Ordinance shall upon conviction be fined in any sum not to exceed TW
HUNDRED AND N0/100 DOLLARS ($200. 00).
SECTION 5. THAT the City Secretary is hereby authorized and directed
to cause the publication of the caption and penalty clause of this Ordinance
once a week for two consecutive weeks as an alternative method of publica-
tion as provided by law.
AND IT IS SO ORDERED.
