AN ORDINANCE ABANDONING AND CLOSING A 20-FOOT ALLEY
LOCATED IN BLOCK 97, OVERTION ADDITION TO THE CITY OF LUBBOCK,
LUBBOCK COUNTY, TEXAS AND MORE PARTICULARLY DESCRIBED IN THE
BODY OF THIS ORDINANCE; DIRECTIN'G THE CITY ENGINEER TO MARK THE
OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND
CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR
PUBLICATION.
WHEREAS, the City Council finds that the alley portion as hereinafter described
in the body of this Ordinance is no longer needed for alley purposes and for public use;
and it would be in the public interest to close, vacate and abandon the same for alley
purposes and for public use, and it would be in the public interest to close, vacate and
abandon the same; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the alley portion as hereinafter described shall BE and the
same is hereby closed, vacated and abandoned for alley purposes and for public use, such
alley portion being more particularly described as follows:
All of the East-West 20-foot alley in Block 97, Overton Addition to the City of
Lubbock County, Texas.
SECTION 2. THAT the City Engineer is hereby authorized and directed to mark
the official maps of the City of Lubbock to reflect said abandonment and closing,
showing the number of this Ordinance and the date of its final passage.
SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or
word of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.

SECTION 4. THAT the City Secretary of the City of Lubbock is hereby
authorized and directed to cause publication of the descriptive caption of this Ordinance
as an alternative method provided by law.
AND IT IS SO ORDERED.

(28.) ORDINANCE NO. 2005v00084-Abandoning and closing a 20-foot
alley between University Avenue and Avenue X in Block 97, Overton
Addition to the City (2402 lOth Street) (Rightvof-Way) (Mayor
McDougal recused) (second and fl~tal readi11g).
This alley portion in the Overton Addition is being closed as part of the
McDougal North Overton redevelopment project. This 20-foot by 600-
foot alley closure area will be replatted into Tract 1-B, Overton Park
Addition, and is located between University Avenue, Avenue X, and 9th
and 1Oth Streets. This ordinance was read for the first time as a regular
agenda item at the July 28, 2005 City Council meeting.
FISCAL IMPACT:
Revenue to the City of $11,550.
The Right-of-Way Department recommended approval of the second
reading of this ordinance.
Ed Bucy, Right-of-Way Agent, gave conunents and answered questions
from Council.
Motion was made by Council Member Gilbreath, seconded by Council
Member Boren to pass on second and fmal reading Ordinance No.
2005-00084 with amendment the property value to $1 per square foot.
Motion carried: 4 Yeas, 2 Nays. Mayor Pro Tern Martin and Council
Member Jones voted Nay.
Mayor McDougal recused himself.
