BLOCK AK. AND SECTION 37, BLOCK AK. CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS: Tracts 1 thru 9 and 19 thru 30 Tracts 10., 11., 18 31 and 32 Tracts 13 and 14 Tracts 12., 15 and 16 Tract 17 From R-1 R-1 R-1 R-1 R-1 To M-1 C-4 C-2 A-1 C-3 Lots I thru 8 R-1 R-2 I THE ABOVE LOTS AND TRACTS ARE SHOWN ON A PRELIMINARY PLAT I OF LOTS l THRU 38 AND TRACTS 1 THRU 33, LA MESA PARK ADDITION. ON FIDE WITH THE OFFICE OF THE SECRETARY OF THE PLANNING I AND ZONING COMMISSION; SUBJECT TO CONDITIONS: PROVIDING A PENA'4TY; PROVIDING A SAVINGS CLAUSE-AND PROVIDING FOR PUBLIG:A TION. WHEREAS., the proposed change in zoning districts as hereinafter made has been duly presented to the Planning and Zoning Commission for its recommendation, which was received by the City Council and, after due consideration., the City Council finds that making the proposed change as hereinafter set out will be in the public interest; and., \ WHEREAS., all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with., as welllas giving notices in compliance with Section 26 of Ordinance No. 7084. a:s well as notices provided by Article l0llf, Vernon's Annotated Civil s (atutes., amended in 1961, and notice was duly.published in the Lubbock Morning Avalanche Journal more than fifteen (15) days prior to the datJ of the public hearing before the City Council on such proposed a:mendrllent., and the public hearing, according to said notice, was duly KJ/dw held in the City Council Room on the second floor of the City Hall, Lubbock~ Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof: NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: ZONE CASE NO, 2011 Make the following changes on a Tract of Land out of 'section 36, Block AK, and Section 37. Block AK, City of Lubbock, Lubbock County, Texas: Tracts l thrµ 9 and 19 thru 30 Tracts 10, 11, 18 31 and 32 Tracts 13 and 14 Tracts 12, 15 and 16 Tract lr Lots 1 thru 8 From R-1 R-1 R-1 R-1 R-1 R-1 To M-1 C-4 C-2 A-1 C-3 R-2 The above Lots and Tracts are shown on a preliminary plat of Lots 1 thru 38 and Tracts 1 thru 33, La Mesa Park Addition on file with the office of the Secretary of the Planning and Zoning Commission. SUBJECT TO THE FOLLOWING CONDITIONS ON THE 11C-4" AND 11M-l11 • PROPERTY: -2- KJ/dw 1. Any outside storage shall be screened by a solid six (6) foot fence of wood or masonry construction and shall be permanently maintained. 2. Outside storage shall not exceed the height of the screening fence. 3. The building height in the 11M -111 zone shall be limited to thirty (30) feet9 including billboards. 4. Uses shall be limited to those uses permitted in 11C-411 and 11M-111 districts. Specific use requirements shall apply, j ncl uding approval of site pl ans as developed. 5. A building permit for development of the subject property shall be applied for and secured and 30% of the development shall be completed within 24 months of the effective date of this Ordinance or all undeveloped property shall automatically revert back to the previous zoning classification. SECTION 2. THAT from and after passage and effective date of I this Ordinance said lots, tracts and parcels of land described in Section 1 hereof Jhall be changed to the Zoning District indicated and the Official Map is b ended in accordance herewith. I SECTION 3. THAT any person, firm or corporation owning or operating the subject property failing to comply with the conditions imposed by Section 1 hereof shall be guilty of a misdemeanor and upon conviction thereof,! shall be subject to a fine not to exceed TWO HUNDRED DOLLARS and each and every day's violation thereof shall constitute a separate and distinct offense. '[he failure of any corporation owning or operating the subject propertf to comply with any of the conditions imposed by Section 1 hereof shall rehder the President, Vice-President., General Manager, Local Managef and Local Agent liable to the penalty prescribed in this Section. SECTION 4. THAT should any section, paragraph, sentence, clause, phrase Ar word of this Ordinance be declared unconstitutional or invalid for any ~eason., the remainder of this Ordinance shall not be affected thereby] SECTION 5. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternativ method provided by law. -3- K J/dw AND IT IS SO ORDERED.
