Alley Located In Block 129, Overton - 07/28/2005First Reading July 28, 2005 Item 48 ..,_ And Return r 0 ~ Bucy R-o.w Second Reading August 8, 2005 Item 29 ORDINANCE NO. 2005-:00083 AN ORDINANCE ABANDONING AND CLOSING A 20-FOOT ALLEY LOCATED IN BLOCK 129, OVERTION ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the alley portion as hereinafter described in the body of this Ordinance is no longer needed for alley pmposes and for public use; and it would be in the public interest to close, vacate and abandon the same for alley purposes and for public use, and it would be in the public interest to close, vacate and abandon the same; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the alley portion as hereinafter described shall BE and the same is hereby closed, vacated and abandoned for alley purposes and for public use, such alley portion being more particularly described as follows: All of the East portion of the East-West 20-foot alley from the west lot line of Lot 7 and Lot 18 to the west right-of-way line of Avenue X in Block 129, Overton Addition to the City of Lubbock County, Texas. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. ORDINANCE NO. 2005-00083-Abandoning and closing a portion of a 20·foot alley west of Avenue X in Block 129, Overton Addition to the City (2402 9th Street) (Right-of-Way) (Mayor McDougal recused) (second and final reading). This alley portion in the Overton Addition is being closed as part of the McDougal North Overton redevelopment project. This 20-foot by 350- foot alley closure area will be replatted into Tract 1-C, Overton Park Addition, and is located just west of A venue X betw'een Glerma Goodacre Boulevard and 9th Street. This ordinance was read for the first time as a regular agenda item at the July 28, 2005 City Council meeting. FISCAL IMPACT: Revenue to the City of $3,275. The Right-of-Way Department recommended approval of the second reading of this ordinance. Motion was made by Council Member Gilbreath, seconded by Council Member Boren to pass on second and final reading Ordinance No. 2005-00083 with amending the property value to $1 per square foot. Motion carried: 4 Yeas, 2 Nays. Mayor Pro Tern Martin and Council Member Jones voted Nay. Mayor McDougal recused himself.
