AN ORDINANCE OF THE CITY OF LUBBOCK AMENDING SECTION 24-
156 OF THE CODE OF ORDINANCES SO AS TO ADD DRAINAGE
IMPROVEMENTS; AMENDING SECTION 24-158 (C) SO AS TO PROVIDE THAT
THE CITY ENGINEER SHALL ACCEPT PAVING WPROVEMENTS REQUIRED
BY CHAPTER 25 OF THE CODE OR ORDINANCES EXCEPT WHERE CITY
COSTS ARE RELATED TO SAID ACCEPTANCE IN WHICH CASE THE CITY
ENGINEER SHALL SUBMIT THE SAID WPROVEMENTS TO THE CITY
COUNCIL FOR CONSIDERATION: PROVIDING A SAVINGS CLAUSE AND AN
EFFECTIVE DATE.
WHEREAS, the City Council of the City of Lubbock finds it to be in the best
interests of the citizens of the City to clarity the procedures for acceptance of paving and
drainage improvements in the City.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF LUBBOCK:
SECTION 1. THAT Section 24-156 of the Code of Ordinances, City of Lubbock,
Texas, is hereby amended to read as follows:
Sec. 24-156. Improvements to become city property upon acceptance.
Any paving or drainage improvement constructed under the article upon any
public street in the city, upon final acceptance by the City Council or the city
engineer, shall become the property of the city.
SECTION 2.' .THAT section 24-158 (c) (7) of the Code or Ordinances, city of
Lubbock, Texas, is hereby amended to read as follows:
(7) After final inspection and approval of the paving improvements required by
Chapter 25 of this code by the city engineer, the city engineer shall accept the said
improvements, except where city costs are related to the said acceptance in which
case the city engineer shall submit the said improvements to the city council for
their consideration for approval and acceptance.
SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of
this Ordinance be declared unconstitutional or invalid for any reason, the remainder of
this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary is hereby authorized to cause publication
of the descriptive caption of this Ordinance as an alternative method provided by law.
AND IT IS SO ORDERED.
