CITY OF LUBBOCK, TEXAS. ENTITLED 11ELECTRICITY11, BY AMENDING SECTION 11-1 THEREOF PROVIDING FOR A FUEL COST ADJUSTMENT: AMENDING SECTION 11-1 THEREOF PROVIDING FOR RATES FOR ALL CLASSES OF ELECTRIC SERVICE; REPEALING SECTION 11-3 THEREOF, PROVIDING AN EFFECTIVE DA TE OF THIS ORDINANCE; PROVIDINGA SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council, after receiving the recommendations of City Staff, r1epresentatives of the Electric Utility Companies and of the citizens of th City of Lubbock, Texas, at a public hearing on the matter germane to the subje t hereof, has determined that the rates set forth below are reasonable, neces- sary and proper and should therefore be adopted; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 11-1 of Chapter 11 of the Code of Ordinances, City of Lubbock, BE and is hereby amended to read as follows: Section 11-1. Rates for service furnished in City. The following rates shall be charged for electric service fur- nished in the city according to classifications herein set out, by all persons, firms or corporations engaged in furnishing such electric power service to the public, including electric service furnished by the city's electric light system; provi- ded however, the net charge per kilowatt hour., as specifi- cally set out hereinafter, shall be increased or decreased o. 0069 cent per kwh for each O. 5 cent increase or decrease, or major fractions thereof, in the cost of fuel delivered at LP&L generating stations, above or below 21 cents per 1, 000, 000 BTU. The cost of fuel shall be determined as follows: 1. Natural Gas: Cost Per thousand cubic feet@!, 000, 000 BTU shall be adjusted each quarte!i pommencing on the first day of September 1975, and the first day of each third month thereafter: based on the projected cost of natural gas for the middle month of the succeeding quarter. A report of the projected cost and the fuel cost adjustment based thereon shall be filed with the City Secre tarywith copies provided to all Council Members by the tenth (10th) day of the month prior to the commencement of the 1:1uarter. 2. Fuel Oil: Cost Per 1, 000, 000 BTU based on a six month moving average through the end of the next prior month; by the last in first out inventory cost method. ,·· JPB:cab, RESIDENTIAL Applicable: To residential customers for lighting and inci- dental purposes., including the operation of electric refrigera- tors, air conditioning equip·ment and ranges where used in private residences., individual family apartments and in pri- vate garages, Rate: First 100 kwh used per month @ 4. 60¢ per kwh Next 22 kwh used per month @ 3. 45¢ per kwh Additional kwh used per month@ 2. 22¢ per kwh The ·minimum shall be $1. 85 per month. Fuel cost adjustment: As above provided. TOTAL ELECTRIC RESIDENTIAL SERVICE Applicable: Only to total electric residential customers for lighting., water heating., space heating., and other purposes Jrhere used in private residences or individually metered I family apartments. Rate: Summer months--May through October ~ 40¢ per kwh for first 50 kwh used per month 4. 88¢ per kwh for next 50 kwh used per month 2. 40¢ per kwh for next 100 kwh used per month 1. 15¢ per kwh for next 500 kwh used per month 2. 40'6 per kwh for next 800 kwh used per month 2. 06¢ per kwh for all additional kwh used per month Winter months--November through April 7. 40¢ per kwh for first 50 kwh used per month 4. 88¢ per kwh for next 50 kwh used per month 2. 40¢: per kwh for next 100 kwh used per month 1. 15¢: per kwh for next 500 kwh used per month 2. 40i per kwh for next 300 kwh used per month 1. 15¢: per kwh for all additional kwh used per month Fuel cost adjµstment: As above provided. I Conditions and regulations: . Water heating equipment served on this rate shall be of insulated storage type -2- ' . ~- ., JPB:cab bearing the approval of the Underwriter1s Laboratories, Inc., and shall have a demand of not greater than 5. 5 kilowatts, individual capacity. Space heating equipment and the instal- lation of the equipment shall be subject to the approval of the supplying utility. A customer must have permanently installed and in regular use space heating equipment having a total connected load of not less than 5 kilowatts. (;haracter of service: The voltage and characteristics of equipment applied shall meet requirements of the sup- plying utility. Minimum charge: $1. 85 per month for 25 KWH, or less. I COMMERCIAL Applicable: To all co·mmercial places of business, including stores, shops, factories, warehouses., hotels, lodges, churches, apartment houses on one meter, garages and filling stations. Rate: All energy used shall be billed in accordance with the fol- lowing rate: First 100 kwh used per month @4. 80¢ per kwh Next 900 kwh used per month @3. 00¢ per kwh Next 4000 kwh used per ·month @2. 40</ per kwh Next 15000 kwh used per month @1. 80i per kwh Additional kwh used per month @1. 20/ per kwh Fuel cost adjustment: As above provided. Q;haracter of service: If metered on secondary side of dis- tribution transformers lighting service may be either 120 / 2~0 volt, 3 wire single phase, or 120 volt~ 2 wire single J hase. If polyphase service is required, it shall be 3 phase, 2~40 volts, unless otherwise specified. Where primary metering is used, service supplied will be the primary voltage serving the area, single or polyphase as the case may require. Discount: Where primary metering is used, 10% will be de ducted on all bills except minimum monthly bills., pro- vl ded that primary metered load is greater than secondary I metered load • Minimum bill: $2. 40 per month. -3- -· JPB:cab SCHOOLS Applicable: To all institutions whether private, parochial or public, engaged in providing instruction or education, including elementary schools, junior high schools, high schools, and colleges or universities. Rate: Shall be the same as established for commercial places of business, above; provided however, that where such schools and school facilities are operated under one authority or entity or as one district, but at several loca- tions within the city, the consumption at all such locations ·may be added together and the authority, entity or district billed as if all such consumption was on one ·~eter. -Fuel Cost Adjustment: As above provided. 1 <Character of service: If metered on secondary side of dis- ~ribution transformers, lighting service may be either 120/ 240 volt, 3 wire single phase, or 120 volt, 2 wire single ~hase. If polyphase service is required, it shall be 3 phase, 240 volts, unless otherwise specified. I ouse service. <Eharacter of service-: Service shall be 240 volt single phase or 240 volt three phase unless otherwise specified. I 13,ate: All kwh per month@ 1. 80t per kwh. J:: Cost Adjustment: As above provided. I Payment: Statements will be rendered at regular ·meter read- ing dates each month. The amount of such statement shall then b.ecome payable ten days after the bill for such service is rendered. -4- JPB:cab Conditions: Service will be supplied through a circuit to which no equipment except the irrigation well motor will be connected. l ELECTRIC HEATING SERVICE Applicable: To residential and commercial customers for water heating and/ or space heating service., including re - sistance heating., radiant heating and heat pumps., when all heating service is supplied at one point of delivery and meas- ured through one kilowatthour meter which meter must be separate from the meter which measures the energy for lighting and general use. Space heating rate: Winter months: all kwh used per month @ 1. 15¢ per kwh. 1 Summer months: All kwh used per month shall be com- 1:ilned and billed under the applicable residential or com- ·rh.ercial rate., except that the first 300 kwh used per ilionth through the heating meter will be billed @ 1. 15¢ ~wh when the customer has an electric water heater in- stalled and in use. Winter ·months: The billing months of Nove·mber to April, inclusive. Summer months: May to October inclusive. I 1:µlel cost adjustment: As above provided. I (ionditions and regulations: Water heating equipment served o'n this rate shall be of insulated storage type bearing the Jpproval of the Underwriter's Laboratories, Inc. and shall h~ave a demand of not greater than 5. 5 kilowatts. Space h1eating equipment and the installation of the equipment shall b1e subject to the approval of the supplying utility. To be e1igible for the space heating rate~ a customer must have Pf rmanently installed and in regular use space heating equipment having a total connected load of not less than 5 kilowatts. -5- JPB:cab Character of service: The voltage and characteristics of equipment applied shall meet requirements of the supplying utility. Minimum charge: $1. 15 per month for water heating service. $4. 60 per month for space heating service during the winter months. ELECTRIC WATER HEATING SERVICE ONLY Applicable: To water heating service in homes or com- ·mercial establishments. Service under this rate is sub- J~ct to the conditions and regulations governing water ft eating as stated below. Rate: All kwh per month@ 1. 15¢ per kwh. -,.- Fuel cost adjustment: As above provided. I <Eonditions and regulations: I (1) Water heating equipment served on this rate shall be of insula·ted storage type bearing the approval of the Underwriter1s Laboratories, Inc., and shall have a de·mand of not greater than 5. 5 kilowatts individual capacity. (2) Service will be supplied through a separate circuit to which no equipment except the water heater will be connected. A separate meter will be furnished by the supplying utility. Minimum charge: $1. 15 per ·month. I SEGTION 2. THAT Section 11-3 of Chapter 11 of the Code of Ordinances, • City of I!.ubbock, BE and is hereby repealed. SECTION 3. The rates established by this Ordinance shall become effec- tive on and apply to all accounts scheduled for billing on and after September • 1975. -6- I JPB:cab SECTION 4. THAT should any section_. paragraph .. sentence., clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason., the .re·mainder of this Ordinance shall not be affected thereby. SECTION 5. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
