ORDINANCE NO. 7100
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AND THE
OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE
FOLLOWING CHANGE: ZONE CASE NO. 1153-B: CHANGE A TRACT OF
LA;N'D OUT OF THE NORTHEAST ¼ OF SECTION 6, BLOCK E-2,
TRACT 1 OF THE LOWREY SUBDIVISION, CITY OF LUBBOCK, LUBBOCK
COUNTY, TEXAS, FROM 11R-l11 AND "R-1" SPECIFIC USE, TO "C-311
EXCEPT THAT PORTION OF SAID TRACT WHICH IS NORTH OF AND
ABUTS 38TH STREET AND EXTENDS 1.5:5 11 ,WEST FROM THE EAST LINE
OF SAID TRACT AND 17':51 NORTH, WHICH SHALL BE ZONED "A-1";
SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A
SAVINGS1 CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, the proposed change in zoning districts as hereinafter
made has been duly presented to the Planning and Zoning Commission for
its recommendation, which was received by the City Council and, after due
consideration, the City Council finds that making the proposed change as
hereinafter set out will be in the public interest; and.
I WHEREAS, all conditions precedent required by law for a valid amend-
ment t ~ the Zoning Ordinance and Map have been fully complied with, as
well a ~ giving notices in compliance with Section 20 of Ordinance No. 1695
as well! as notices provided by Article l0llf, Vernon's Annotated Civil
Statuteb, amended in 1961., and notice was duly published in the Lubbock
Mornitjg Avalanche Journal more than fifteen (15) days prior to the date of
the pul}lic hearing before the City Council on such proposed amendment, and
the putflic hearing according to said notice was duly held in the City Council
Room on the second floor of the City Hall, Lubbock, Texas, at which time
persons appeared in support of the proposal: and~ after said hearing, it
was by the City Council determined that it would be in the public interest,
due to f hanged conditions., that the Zoning Ordinance and the Zoning Map
be a-mended in the ·manner hereinafter set forth in the body of this
Ordinah.ce and this Ordinance having been introduced prior to first reading
hereod NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map
BE and the same are hereby amended as follows, to-wit:
ZONE CASE NO. 1153-B
Change a Tract of Land out of the Northeast ¼ of
Section 6., Block E-2., Tract 1 of the Lowery Sub-
division, City of Lubbock, Lubbock County., Texas,

from 11R-111 and "R-111 Specific Use to 11C-311,
except that portion of said Tract which is North
of and abuts 38th Street and extends l!j55'1 West
from the East line of said Tract and 1751 North
which shall be zoned 11A-111 •
PROPERTY IS FURTHER DESCRIBED BY METES AND BOUNDS AS
FOLLOWS:

SUBJECT TO THE FOLLOWING CONDITIONS:
1. Development on the "C-311 portion shall be limited to 11C-311
uses and standards in effect at the time of the effective date of
this Ordinance.
2. The alley be moved Nor.th to line up with the existing alley
and with a 901 setback off of Brownfield Highway and Slide
Road.
SECTION 2. TBA T from and after passage and effective date of this
Ordinance said lots, tracts and parcels of land described in Section l hereof
shall be changed to the Zoning District indicated and the Official Map is
a:mended in accordance herewith.
SECTION 3. THAT any person, firm or corporation owning or operating
the subject property failing to comply with the conditions imposed by Section
l hereof shall be guilty of a misdemeanor and upon conviction thereof,
shall b ~ subject to a fine not to exceed TWO HUNDRED DOLLARS and each
and evJ ry day's violation thereof shall constitute a separate and distinct
off ens el.
Thejfailure of any corporation owning or operating the subject property
to comply with any of the conditions imposed by Section l hereof shall render
the President, Vice-President, General Manager, Local Manager and Local
Agent liable to the penalty prescribed in this section. I
SECTION 4. TBA T should any section,. paragraph., sentence, clause,
phrase or word of this Ordinance be declared unconstitutional or invalid
for any reason, the remainder of this Ordinance shall not be affected thereb •
SECTION 5. THAT the City Se ere tary is hereby authorized to cause
publication of the descriptive caption of this Ordinance as an alternative
method provided by law.
AND IT IS SO ORDERED.
