HomeMy WebLinkAboutOrdinance - 2005-O0075 - Item Failed On Second Reading On July 28, 2005; Abandoning/Closing 2 Alley - 07/14/2005Fint Reading July 14, 2005 Item 13 ORD.u'JANCE NO. 200.5-:00075 Second Reading July 28, 2005 ltem3S TIHS ITEM FAILED INANCE ABANDONING AND CLOSING TWO ALLEY PORTIONS LOCATED TRACTS 9 AND 10, STUBBS ADDITION TO THE CITY OF LUBBOCK, L BOCK COUNTYt TEXAS AND MORE PARTICULARLY DESCRIBED THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR P LICATION. WHEREAS, the City Council finds that the alley portions as hereinafter described in the body of this Ordi ce are no longer needed for alley purposes and for public use; and it would be in the p blic interest to close, vacate and abandon the same for: alley purposes and for public ) and it would be in the public interest to close, vacate and abandon the same; NOW T REFORE: BE IT ORDAINED BY THE ITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the ley portions as hereinafter described shall BE and the same are hereby closed, vacated rl. abandoned for alley purposes and for public use, such alley portions being more part ularly described as follows: Alley Dedication Deed filed for re ord in Volume 445, Page 538 of the Deed Records of Lubbock Countyt Texas and described as that part of Tracts 9 and 10, Stubbs Addition to the City ofLubb ck, Lubbock County, Texas; BED'JG 10 feet South and 100 feet We t of the Northeast corner of Tract 9t Stubbs Addition aforesaid, for the place fbeginning; THENCE West 7.5 feet to a point; THENCE North 110 feet to a point; THENCE East 7.5 feet to a point; THENCE South 110 feet to a point and place o TRACT2 Alley Dedication Deed filed for record in Volwne 449, Page 111 of the Deed Records of Lubbock County, Texas, and described as that part of Tracts 9 and 10, Stubbs Addition to the City of Lubbock, Lubbock County, Texas; Being 10 feet South and 92.5 feet West of the Northeast comer of Tract 9, Stubbs Addition aforesaid; THENCE West 7.5 feet to a point; THENCE North 110 feet to a point; THENCE West 5 feet to a point; THENCE North 50 feet to a point; THENCE East 7.5 feet to a point; THENCE South 50 feet to a point; THENCE East 5 feet to a point; THENCE South 110 feet to a point and place of beginning. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandorunent and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. 2 SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
